<br />e <br /> <br />SECTION 1008 - SUBDIVISION ORDINANCE <br /> <br />1008.00 - SHORT TITLE <br /> <br />This ordinance shall be known as the "SUBDIVISION ORDINANCE OF THE <br />CITY OF ELK RIVER" and will be referred to herein as "this <br />Ordinance." <br /> <br />1008.02 - PURPOSE <br /> <br />All subdivisions of land hereafter submitted for approval shall <br />fully comply, in all respects, with the regulations set forth <br />herein. It is the purpose of these regulations to: <br /> <br />1. Provide for and guide the orderly, economic and safe <br />development of land and urban services and facilities. <br /> <br />2. Encourage well-planned, efficient, and attractive <br />subdivisions by establishing adequate standards for design <br />and construction. <br /> <br />3. <br /> <br />Facilitate adequate prov~s~on for streets, transportation, <br />water, sewage, storm drainage, schools, parks, playgrounds, <br />and other Public services and facilities. <br /> <br />e <br /> <br />4. Place the cost of improvements against those benefiting from <br />their construction. <br /> <br />5. Secure the rights of the public with respect to public lands <br />and waters. <br /> <br />6. Set the minimum requirements necessary to protect the public <br />health, safety, and general welfare. <br /> <br />1008.04 - SCOPE AND LEGAL AUTHORITY <br /> <br />e <br /> <br />The rules and regulations governing plats and subdivision of land <br />contained herein shall apply within the boundaries of the City of <br />Elk River (the City) in accordance with and as permitted by <br />Minnesota Statutes (the Law). Except in the case of <br />resubdivision, this Ordinance shall not apply to any lot or lots <br />forming a part of a subdivision recorded in the office of the <br />County Recorder prior to the effective date of this Ordinance, nor <br />is it intended by this Ordinance to repeal, annul or in any way <br />impair or interfere with existing provisions of other laws or <br />ordinances except those specifically repealed by, or in conflict <br />with, this Ordinance, or with restrictive covenants running with <br /> <br />10.16 <br />
