A PUD agreement shall be approved by the City Council and lJ - <br />signed by both parties prior to the issuance of building permits u CR33 <br />for any building within the project area. <br />2. The field road access to Highway 10 shall be removed and <br />vacated in accordance with MnDOT standards. <br />3. All comments noted in the staff comment letter dated May 7, RR <br />2021, shall be addressed prior to sending the PUD agreement ` <br />to the City Council for approval. • Hwy 10 <br />CR 12 <br />Recommend, by motion, the Preliminary Plat for Broadway on 10. <br />Background/Discussion <br />The applicant has proposed a multi -family residential development P� <br />north of the West Oaks Subdivision. The site had previously been the by <br />subject of a residential PUD and is already zoned as such. The <br />application package includes a CUP to modify the existing PUD and <br />establish the residential use, and a preliminary plat to create one parcel <br />for the proposed apartment building, and 24 townhome lots. Figure i _ <br />The proposal includes an 88-unit apartment building and 24 townhome units.
