<br />. <br /> <br />. <br /> <br />. <br /> <br />City Council Minutes <br />July 18,2005 <br /> <br />Page 7 <br /> <br />Councilmember Motin stated the market value of the parcels would be affected and the <br />current owners may be pursued by developers. <br /> <br />City Attorney Peter Beck stated that for cities outside the metro area the Comprehensive <br />Plan is more an advisory plan; while if within the metro area it would be required to match <br />with the zoning map. <br /> <br />Councilmember Farber stated if the property owner is not interested in the rezoning, then it <br />should be left as is and the property owner can apply and pay for a rezoning at a later date. <br /> <br />MOVED BY COUNCILMEMBER FARBER AND SECONDED BY <br />COUNCILMEMBER MOTIN TO WITHDRAW THE CITY'S APPLICATION AS <br />IT RELATES TO PARCELS 2 AND 3. MOTION CARRIED 5-0. <br /> <br />5.4. Consider Ordinance to Amend Section 30-793 of the City of Elk River Land Use <br />Regulations Relating to Fabric Accesso:J;y Structures. Public Hearing-Case No. OA 05-09 <br /> <br />Director of Planning Michele McPherson submitted the staff report. Ms. McPherson stated <br />the city is asked to consider an ordinance amendment to allow engineered fabric structures <br />in the Al and Rla zoning districts. She provided a history of Council and Planning <br />Commission action regarding fabric structures. <br /> <br />Mayor Klinzing opened the public hearing. There being no one to speak to this issue, Mayor <br />Klinzing closed the public hearing. <br /> <br />Mayor Klinzing stated she was concerned about enforcement issues and doesn't want <br />people storing equipment or animals in the fabric structures. <br /> <br />Councilmember Farber stated he didn't see any problems with storing equipment in the <br />structures. <br /> <br />Councilmember Gumphrey stated he didn't care if equipment was stored in the structures as <br />long as he doesn't have to see it stored outside in people's yards. <br /> <br />Ms. McPherson stated that the fabric structures are not the small ones that are sold at home <br />improvement stores but must be engineered to handle snow and wind loads. <br /> <br />Councilmember Motin stated the setbacks should be further back than normal setbacks. <br /> <br />Mayor Klinzing concurred. <br /> <br />Discussion was held on what the setback should be and whether the lots should be set at 10 <br />acres or more. <br /> <br />Councilmember Dietz stated he didn't want to see fabric structures anywhere in the city. <br /> <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY <br />COUNCILMEMBER FARBER TO ADOPT ORDINANCE 05-16 AMENDING <br />SECTION 30-793-ACCESSORY BUILDINGS OF THE CITY CODE OF <br />ORDINANCES WITH THE FOLLOWING MODIFICATIONS, CASE NO. OA <br />05-09. <br />
