EV 05-06 <br />WITH THE FOLLOWING CONDITION: <br /> <br />1. THE APPLICANT SHALL PROVIDE NEW DRAINAGE AND <br />UTILITY EASEMENTS AS PART OF HILLSIDE ESTATES 10TH <br />ADDITION. <br /> <br />MOTION CARRIED 5-0. <br /> <br />5.2. Request by Tim Pomerleau for Preliminary Plat Approval (Kliever Lake Fields 3rd Addition). <br />Public Hearing-Case No. P 05-09 <br /> <br />Senior Planner Scott Harlicker submitted the staff report. Mr. Harlicker stated the applicant <br />is requesting preliminary plat for Kliever Lake Fields Third Addition, a 78 unit townhome <br />development. He discussed lot layout and density, street layout, access, parking, landscaping, <br />and the Planning Commission's recommendation. Mr. Harlicker stated a preliminary plat for <br />Kliever Lake Fields 3rd Addition was approved a few years ago but the applicant is <br />requesting significant changes so he had to complete a new preliminary plat application. <br /> <br />Mayor Klinzing opened the public hearing. There being no one to speak to this issue, Mayor <br />Klinzing closed the public hearing. <br /> <br />Councilmember Gumphrey questioned the type of design changes that were made to this <br />revised plat. <br /> <br />Horst Graser, representing Tim Pomerleau-Stated that due to changes in the market they <br />needed to change the style of townhome to build from row style to back to back style. <br /> <br />Councilmember Motin stated he voted against this parcel being rezoned to R3 when it first <br />came to Council and he would be voting against this project again. He stated that according <br />to the Comprehensive Plan, townhomes should only be allowed as a buffer between <br />residential areas and commercial/industrial areas. He stated the applicant has added 10 more <br />townhome units to this project and it would serve no benefit to the city. He stated there is a <br />glut in the Elk River townhome market. <br /> <br />Mayor Klinzing stated she had not been in favor of the R3 zone change. She stated this <br />project is too dense and questioned why more units need to be added to the project. <br /> <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY MAYOR <br />KLINZING TO DENY THE PRELIMINARY PLAT FOR KLIEVER LAKE <br />FIELDS THIRD ADDITION. <br /> <br />City Attorney Peter Beck suggested the Council have staff prepare written findings and to <br />bring it back to Council. <br /> <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY MAYOR <br />KLINZING TO CONTINUE THE ORIGINAL MOTION TO THE AUGUST 15, <br />2005 COUNCIL MEETING. MOTION FAILED 2-3. Councilmembers Dietz, <br />Gumphrey, and Farber opposed. <br /> <br />Mayor Klinzing stated the continuing motion failed so the Council is back to the original <br />motion and needs to take action on the motion to deny. <br />
