The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
<br />mill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public
<br />health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the city.
<br />The proposed use is an extension of the use currently operating on the property. The only nearby use is a
<br />semi -tractor dealership. The use will not endanger, injure or detrimentally affect the use and enjoyment of
<br />other property in the immediate vicinity or the public health, safety, morals, comfort, convenience, or
<br />general welfare of the neighborhood or the city.

<br />2. mill be consistent with the comprehensive plan.
<br />The property is guided for FAST, which promotes light manufacturing uses. The use will be consistent
<br />with the comprehensive plan.

<br />3. mill not impede the normal and orderly development and improvement of surrounding vacant property.
<br />There are three vacant parcels in the development west of the subject site, also guided for the same types
<br />of uses. East of the subject site is the Cargill land which is currently used for agriculture. The proposed
<br />use will not impede the normal and orderly development and improvement of these surrounding vacant
<br />properties.
<br />Additionally, the parcel along the southwest corner of subject site does not have access to a public street.
<br />During a past Easement Vacation (EV 15-08) an access easement was required on the west portion of the
<br />property which was never recorded. Access to this parcel was to be provided through said easement —
<br />which is shown on the submitted lighting plan. Recording the easement was a requirement of the original
<br />site plan approval but has not yet been completed.
<br />Staff included the condition to record the access easement as shown. This will provide access to adjacent
<br />vacant property.
<br />4. mill be served adequately by and will not adversely affect essential public facilities and services including streets, police and fare
<br />protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic
<br />congestion or interference with traffic on adjacent and neighboring public thoroughfares.
<br />Essential public facilities are available for the subject parcel so the use will be served adequately by and will
<br />not adversely affect essential public facilities and services including streets, police and fire protection,
<br />drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create
<br />traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares.

<br />5. mill not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any
<br />persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations.
<br />As the proposed use is an extension of the use currently operating on the property and the city is unaware
<br />of any detrimental issues, the use will not involve uses, activities, processes, materials, equipment and
<br />conditions of operation that will be detrimental to any persons or property because of excessive traffic,
<br />noise, smoke, fumes, glare, odors, dust, or vibrations.
