<br />1. When it is possible to identify the person(s) causing the specific damage, said <br />person(s) shall be required to compensate the FTCEC as follows: <br />a. Within two (2) weeks of notification of the damage by an official <br />of the FTCEC, submit a payment in the amount of the damages <br />incurred. <br />b. At the discretion of the Facility Superintendent or Assistant <br />Facility Supervisor or personnel, perform cleaning duties at a rate <br />decided upon by the Facility Superintendent for the number of <br />hours sufficient to equal the damages incurred. <br />c. In the discretion of the Furniture and Things Community Event <br />Center, undertake another form of in-kind compensation <br />acceptable to the FTCEC. <br /> <br /> <br /> <br />Furniture and Things Community Event Center <br />SECTION 10 <br />DAMAGE DEPOSITS <br /> <br />2. If it is not possible to identify the person(s) causing the damage to the FTCEC <br />property, but it is possible to identify the group or association to which the <br />person(s) causing the damage belongs, then the group or association shall, within <br />two weeks of notification of the damage, submit a payment to the FTCEC for <br />the full amount of the damages incurred. This provision applies to groups or <br />associations holding a function (i.e. ice time, social gathering, fieldhouse rental, <br />etc.) and to visiting groups or associations. <br />C. FAILURE TO COMPENSATE <br />1. If an identified person(s)/group fails to fulfill the compensation requirements set <br />forth above for any damage caused, such person(s) shall not be permitted to use <br />the facilities of the FTCEC until payment is made. <br />2. If a group or association with an ice contract or visiting party fails to fulfill the <br />compensations requirements set above, use of the facility of the affiliated group <br />or association or visiting party, as the case may be, shall be suspended until <br />appropriate payment is made. <br /> <br />10.5 LIABILITY INSURANCE <br />A. The User shall provide the requested Liability Insurance upon request from the FTCEC <br />Commission. The User shall be informed of when it is necessary to provide the <br />insurance and the levels during the reservation process. <br />B. Upon request, the User shall provide a Certificate of Insurance with a minimum of <br />$1,000,000.00 unless otherwise determined by the city’s insurance agent and/or city <br />attorney. The Certificate of Insurance shall list the City of Elk as an additional insured. <br />7 <br /> <br /> <br />
