* Item # 3.10*

MEMORANDUM

TO:

Mayor and City Council

FROM:

Joan Schmidt, City Clerk

DATE:

August 1, 2005

SUBJECT:

Application to Conduct Off-Site Gambling by Elk River Youth
Hockey

REQUEST

The Elk River Youth Hockey has requested an application to conduct off-site gambling.
While looking through their records, I discovered that they never asked to change their
premises permit to conduct charitable gambling from Mitch Miller's Olde Town Tavern to
McCoy's Pub which is the name of the current business at that location (651 Main Street). I
have put together a resolution for this purpose and also for them to conduct off-site
gambling.

The Elk River Youth Hockey would conduct off~site gambling for pull-tabs and a raffle on
September 9, 2005 as part of their annual Fundraising Golf Tournament for Elk River
Youth Hockey. This event will take place at the Elk River Country Club. Because the raffle
event will not take place at the location of the Premise Permit, the State requires that the
Council adopt a resolution approving an application for off-site gambling.

ACTION REQUESTED

Council motion adopting the two attached resolutions (1) approving a premises permit for
the Elk River Youth Hockey Association to conduct lawful charitable gambling at McCoys
Pub until the expiration date of June 30, 2006; and (2) for the Elk River Youth Hockey
Association to conduct annual off-site gambling.
