City Council Minutes Page 7 <br />October 5, 2020 <br />----------------------------- <br />cite violators for trespassing only after giving verbal notice and the person still <br />refuses to leave. <br /> <br />Councilmember Wagner questioned if the city would be more liable if the trail <br />weren’t closed for the nearby hunters. <br /> <br />Chief Nierenhausen stated individuals who discharge a firearm would be liable. He <br />stated, per Mr. Baumgartner, there is also liability assumed by the city by closing a <br />public space for private use. <br /> <br />Councilmember Wagner disagreed stating there is an overpopulation of deer in the <br />city which needs to be controlled and would be for the public good. <br /> <br />Mr. Beck stated this is a Council policy decision. He stated Council could make it a <br />city code violation for trespass. <br /> <br />Mayor Dietz stated he’d like to pass the ordinance allowing the trail closure for <br />hunting. <br /> <br />Councilmember Westgaard and Wagner concurred. <br /> <br />Mr. Beck stated indemnification language could be incorporated as part of the <br />permitting process. <br /> <br />Chief Nierenhausen expressed concern with signage language and people following <br />it. He further suggested staff be directed to install the signage versus the hunters. <br /> <br />Council consensus was for this item to come back to the October 19, 2020, meeting. <br /> <br />8.2 Open Bodycam Proposed Purchase to Public Comment <br /> <br /> Chief Nierenhausen presented the staff report. <br /> <br />Moved by Councilmember Ovall and seconded by Councilmember Westgaard <br />to direct the Elk River Police Department to seek public comment, per state <br />law, regarding the department’s proposed body camera program. Motion <br />carried 5-0. <br /> <br />8.3 Discuss Work Session Items <br /> <br />Councilmember Wagner suggested a joint meeting with the county and the school <br />district after the new year. <br /> <br />9. Council Liaison Updates <br /> <br />Each Councilmember provided an update which is further outlined in the respective <br />advisory board minutes. <br /> <br />
