line of Section Three (3), Township 32, Range 26, Sherburne County, Minnesota, and extending <br />approximately 700 feet east and 240 feet, south of said point of intersection, which tract is also <br />located in the vicinity of and northerly from the present plant sit of the Rural Cooperative Power <br />Association, <br /> <br />WHERAS, the Rural Cooperative Power Association has manifested an interest in acquiring the title <br />to such part of Government Lot 4, Section Three (3), Township 32, Range 26, not needed for said <br />sewage disposal plant, and <br /> <br />WHEREAS it has been determined those portions of said Government Lot 3 required by this <br />council for sewage disposal site and by the R.C.P.A. for plant purposes, are owned by the State of <br />Minnesota, having been acquired for highway purposes, and in particular for borrow pit usage, and <br /> <br />WHEREAS, this council has been advised that the former owner and his spouse of said portions of <br />Government Lot 3 are deceased, and that under existing statutes no method of conveyance of real <br />estate thus owned by the State of Minnesota is permissible except at public auction, after due <br />advertisement of such auction, which procedure would do irreparable harm to the Village of Elk <br />River by increasing the cost of the site to a price that would likely render the construction of the <br />proposed sewage disposal plant economically unfeasible because of the common knowledge that it is <br />the only available plant site, <br /> <br />NOW THEREFORE BE IT RESOLVED, That this council formally endorse, advocate and <br />promote special legislation now before the Minnesota State House of Representatives and Senate <br />authorizing the Commissioner of Highways of the Sate of Minnestoa to recommend the conveyance <br />of the aforedescribed property upon such terms and conditions and he may prescribe to the Village <br />of Elk River and the Rural Cooperative Power Association in such propotions as said Village, Rural <br />Cooperative Power Association, and Commissioner of Highways may agree, and, <br /> <br />BE IT FURTHER RESOLVED THAT The Village Clerk is authorized and directed to transmit <br />copies of this resolution to such representatives, senators, and other interested persons as may <br />require same or need same to further the said special legislation. <br /> <br />th <br />Adopted by the Council this 6 day of April, 1959 <br /> <br />Mayor <br />Attest: Village Clerk <br />
