BE IT FURTHER RESOLVED that the elevations and grades as shown in said plans and <br />specifications be and they are hereby approved and consent is hereby given to any and all changes in <br />grade occasioned by the construction of said Trunk Highway Number 3 renumbered as Trunk <br />Highway Number 10 in accordance with said plans and specifications. <br /> <br />Upon the call of the roll the following Trustees voted in favor of the Resolution: Dan Bailey, August <br />Mayer, Harry Dow, H.A. Briggs. <br /> <br />The following voted against its adoption: none. <br /> <br />WHEREUPON the Mayor and presiding officer declared the Resolution adopted. Briggs, Clerk <br /> <br />Form 2522 S.P. 7101-28 (10-3) <br /> <br />Resolution <br /> <br />th <br />At a regular meeting of the Village Council of the Village of Elk River duly held on the 4 day of <br />September, 1956, the following Resolution was offered by Dan Bailey, seconded by August Mayer, <br />to-wit: <br /> <br />WHERAS, the Village of Elk River has approved the plans and specifications for the improvement <br />of that part of Trunk Highway Number 3 renumbered as Trunk Highway Number 10 within the <br />corporate limits of the Village of Elk River from Depot Avenue to south corp. limits; and <br /> <br />WHERAS, in order to obtain Federal aid in the construction of said Trunk Highways Number 3 <br />renumbered as Trunk Highway Number 10 the Bureau of Public Roads requires the assurance that <br />the Village of Elk River will not suffer any encroachment of any nature or kind whatsoever on the <br />right of way of said Trunk Highway Number 3 renumbered as Trunk Highway Number 10 within <br />the corporate limits of the said Village of Elk River; and <br /> <br />WHERAS, the Commissioner of Highways desires in the interest of public safety that all parking of <br />vehicles on said trunk highway be parallel with the curb and at least 20 feet from any crosswalk. <br /> <br />NOW, THEN, BE IT RESOLVED that said Village of Elk River does hereby agree and covenant <br />that it will never permit or suffer, within its corporate limits, any encroachment of any kind <br /> <br />
