The State’s Project Manager for this Work Order is <br />Name/Title: Luke Wehseler, Project Manager <br />Address: Minnesota Department of Transportation <br /> District 3 – Baxter Office <br /> 7694 Industrial Park Road, Baxter, Minnesota 56425 <br />Telephone: 218-828-5721 <br />E-Mail: luke.wehseler@state.mn.us <br />The State’s Project Manager is responsible for overseeing the State’s fulfillment of its obligations under <br />this Work Order Contract, reviewing and approving invoices, resolving disputes related to this Work Order <br />Contract, and for giving or receiving any notices required or permitted by this Work Order Contract. <br />8. Termination <br />8.1.Termination by the State or Local Government/Agency. The Local Government/Agency, the State or the <br />Commissioner of Administration may terminate this Work Order at any time, with or without cause. Upon <br />termination, the Local Government/Agency will be entitled to payment, determined on a pro rata basis, <br />for services satisfactorily performed. <br />8.2.Termination for Insufficient Funding. The State may immediately terminate this Work Order if it does not <br />obtain funding from the Minnesota Legislature, or other funding source; or if funding cannot be continued <br />at a level sufficient to allow for the payment of the services covered here. Termination must be by written <br />or fax notice to the Local Government/Agency. The State is not obligated to pay for any services that are <br />provided after notice and effective date of termination. However, the Local Government/Agency will be <br />entitled to payment, determined on a pro rata basis, for services satisfactorily performed to the extent <br />that funds are available. The State will not be assessed any penalty if the Work Order is terminated <br />because of the decision of the Minnesota Legislature, or other funding source, not to appropriate funds. <br />The State must provide the Local Government/Agency notice of the lack of funding within a reasonable <br />time of the State’s receiving that notice. <br />9.
