<br />VILLAGE OF ELK RIVER COUNCIL MEETING <br />March 2, 1936 <br /> <br />The regular meeting of the Village Council was held at the Municipal Bldg store Monday March 2, <br />1936 at 8:00 o’clock P.M. <br /> <br />Members present: <br />J.D. Flaherty, Pres.; G.A. Bailey, Geo Cornelius, Wm Patenaude, Trustees; <br />Wm H Greupner, Clerk. <br /> <br />The minutes of the last meeting were read and approved. <br /> <br />Morris Wilson came before the council asking for an appropriation of $50.00 to help maintain the <br />camp grounds that he operates in the Village of Elk River. After some discussion it was decided to <br />bring the matter before the Commercial Club to see if they would pay all or part of this amount. <br /> <br />Chas Jungnickel, John Kramer, John Blocker, Geo Lewis, Gust Paulson, Geo Gonyea, Bob Shannon <br />and A.L. Parker were present at this meeting as they had heard the Council had planned on passing a <br />new ordinance regulating closing hours for selling 3.2 non intoxicating malt liquor. These men <br />expressed their opinion and all wished to have the hours kept the same as they are at the present <br />time. After a lengthy discussion, trustee Bailey presented the following ordinance to read as follows. <br /> <br />Ordinance <br /> <br />The Village Council of the Village of Elk River, Sherburne County, Minnesota, do ordain as follows: <br />Section 1 – It shall be unlawful for any person or persons firm or corporation to sell, or allow to be <br />drank any malt liquor containing 3.2 percent of alcohol or more by volume between the hours of <br />twelve o’clock midnight and six o’clock A.M. during the week days and no such beer shall be sold or <br />drank on any licensed premises between the hours of twelve o’clock midnight and ten o’clock A.M. <br />on Sundays and holidays. <br />Section 2 – That the so-called “skiking” or displaying or drinking from containers having <br />intoxicating liquor of more that 3.2 percent of alcohol upon any of the premises license by this <br />Council to operate in said Village of Elk River is hereby forbidden and the licensee proprietor <br />manager or employees of such place shall keep posted in a prominent place on their premises where <br />it can be seen by everyone, notice that such practiced on said premises will not be tolerated and any <br />disregard of such warning shall be sufficient reason to call a peace officer and to eject such offenders <br />from said premises. <br />Section 3 – The general laws of the State of Minnesota governing the sale of said non-intoxicating <br />beer to minors shall be rigidly enforced by the license of said premises. <br />Section 4 – That any licensee violating any of the provisions of this ordinance or the State or Federal <br />laws, shall upon conviction thereof, be deemed guilty of a misdemeanor and be punishable by a fine <br />of not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00) or by <br />imprisonment in jail for not less than ten (10) days nor more than ninety (90) days. <br />Section 5 – This ordinance shall take effect and be in force from and after its passage and <br />publication according to law. <br />nd <br />Passed by the Village Council this 2 day of March 1936. <br />nd <br />Approved by the President of the Council this 2 day of March 1936. <br /> <br />
