<br />e <br /> <br />e <br /> <br /> <br />e <br /> <br />WHEREAS, following the presentations from staff and the Developer, <br />and the testimony received from the public, the City <br />Council discussed the proposed project and the grounds for <br />denial set forth in the Resolution of Denial; and <br /> <br /> <br />WHEREAS, at the close of its discussion on December 13, 1993, the <br />City Council determined to take no action on the proposed <br />Resolution of Denial, and directed City staff to prepare a <br />Resolution of Approval of the Project, setting forth the <br />grounds for approval and all conditions of approval, for <br />consideration by the City Council at its regularly <br />scheduled meeting on December 20, 1993; and <br /> <br />WHEREAS, in its lengthy consideration of this Project the City <br />Council has reviewed all of the written materials <br />submitted by the Developers, the staff and the public <br />before and during the public hearings held on this matter, <br />and has considered the recommendation of the Planning <br />Commission and the testimony received at the public <br />hearings on October 26, 1993, and December 13, 1993; and <br /> <br />WHEREAS, the Zoning Ordinance of the City of Elk River sets forth <br />in Section 900.42(4) seven criteria for the issuance of a <br />Conditional Use Permit; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Elk River makes the following findings, and approves a <br />Conditional Use Permit for Elk Park Center, subject to the <br />conditions set forth herein: <br /> <br />I. FINDINGS <br /> <br />A. Specific Findings on the Issues Set Forth in <br />Resolution of Denial <br /> <br />1. Drainage. The revised plan conforms to City <br />standards and requirements by providing that all <br />drainage for the Project will be accommodated on <br />site. <br /> <br />2. Traffic. <br /> <br />o <br /> <br />Access from Highway 169. <br /> <br />The Developers have fully investigated the <br />possibility of obtaining full access to the <br />Project from Highway 169. The Minnesota <br />Department of Transportation analysis, as <br />well as the City Engineer'S analysis, is <br />that full access from Highway 169 is not <br />necessary at this time.
