The Judges and Clerk having returned their report to the Village Clerk, together with ballots cast at <br />st <br />the special election held Jan 31, 1941, the Village Clerk laid such report, together with the ballots <br />before the Council and the Council proceeded to examine the returns of said special election. <br /> <br />Upon completion of such examination G.A. Bailey introduced the following resolution and moved <br />its adoption: <br /> <br />Resolution <br />A Resolution canvassing the returns of the Special Election held Jan 31, 1941. Whereas, a special <br />st <br />election was duly held in said Village on the 31 day of Jan, 1941 at which election there was <br />submitted to the electors of said Village the following question: <br />“Shall the Village of Elk River, Sherburne County, Minn. Construct a sanitary sewer systems, <br />including a treatment plant, and avail itself of the W.P.A. Grant to aid in said improvements at a cost <br />of approximately $50,000, said cost to be paid in part by assessments levied against real property <br />abutting on and served by the proposed sewer system and in part by charges to be made for the use <br />of such sewer system by those connected therewith?” and <br /> <br />Whereas, the judges and clerk heretofore duly appointed by this Council did duty county the votes <br />cast proclaim the results and record the same in a book provided for that purpose, and did return <br />said book and the ballot cast to the Village Clerk, which showed the result of said special election to <br />be as follows: <br />Votes cast in favor of sewer system 163 <br />Votes cast again the sewer system 43 <br />Spoiled or blank ballots – <br /> <br />And Whereas the clerk has transmitted the record books of said election and the ballots cast to this <br />Council which has met as a Canvassing Board and canvassed the returns. <br /> <br />Now, therefore, be it resolved by the Village Council of the Village of Elk River, Sherburne County, <br />Minn that this Council does hereby declare the results appearing from said returns to be as follows: <br /> <br />The Village Council studied the surveys and plans submitted to them by Toltz, King and Day, <br />consulting engineers for their guidance in determining the form and extent of sewer districts and <br />thereupon trustee G.A. Bailey introduced the following ordinance which was read in full and found <br />to be in words and figures as follows: <br /> <br />Ordinance No 40 <br /> <br />An Ordinance Creating Sewer District Number One. <br /> <br />The Village Council of the Village of Elk River, Minnesota, Do Ordain as follows: <br />Section 1. That there is hereby created in and for said Village a sewer district to be hereafter known <br />and numbered as Sewer District Number One.” <br /> <br />Section 2. That said Sewer district Number One shall include all the lots, pieces and parcels of land <br />in said Village except that portion of the Village lying south of the Elk River, all as shown by the <br />inspection, surveys, plans and profiles prepared by Toltz, King and Day, Inc. Village Engineers. <br /> <br /> <br />
