ARTICLE I. DEFINITIONS <br /> As used in this Agreement, unless a different meaning clearly appears from the context: <br /> A. "Act"—The Federal Water Pollution Control Act, also referred to as the Clean <br /> Water Act, as amended, 33. U.S.C. 1251 et seq. <br /> B. "City"—The area within the corporate boundaries of the City of Elle River, the <br /> City Council, it's authorized representative, or the authorized representative of the sanitary sewer <br /> district. <br /> C. "SN" means Elle River Landfill and its facility located in the City of Elle River, <br /> Minnesota. <br /> D. "MPGA" means the Minnesota Pollution Control Agency. <br /> E. "National Pollution Discharge Elimination System (NPDES)Permit"—A permit <br /> issued by the MPGA, setting limits on pollutants that a permittee may legally discharge pursuant <br /> to Sections 402 and 405 of the Act. <br /> F. "Slug" is defined as any flow rate or concentration or quantity of pollutants that <br /> may cause inhibition or disruption of the Plant. <br /> G. "Sewage" means Industrial Waste and Sanitary Sewage. <br /> ARTICLE II. AUTHORITY AND SCOPE <br /> A. This Agreement is made pursuant to the City of Elk River's Wastewater <br /> Treatment Ordinance. <br /> B. The language within the Articles of the Agreement shall have precedence over the <br /> language used within the Articles of the Wastewater Treatment Ordinance, as long as all <br /> requirements and the intent of the Wastewater Treatment Ordinance are satisfied. <br /> ARTICLE III. COLLECTION AND TREATMENT <br /> A. Elle River Landfill may discharge to the Sewerage System, and the City will <br /> meter, collect and treat Elle River Landfill sewage, as set forth in this Agreement. <br /> B.
