SIGNIFICANT INDUSTRIES <br /> INDUSTRIAL WASTEWATER <br /> TREATMENT AGREEMENT <br /> THIS Industrial Wastewater Treatment Agreement (hereinafter referred to as <br /> "AGREEMENT") is made and entered into this 7fh day of October, by and between the City of <br /> Elle River, Minnesota, a municipal corporation (hereinafter referred to as "City") and Elle River <br /> Landfill, Inc, a corporation under the laws of the State of Minnesota(hereinafter referred to as <br /> "Elk River Landfill"). <br /> WHEREAS, the City is the owner and operator of a Wastewater Treatment Plant <br /> (hereinafter "Plant") located within the City of Elk River, County of Sherburne, and State of <br /> Minnesota, which has continuous discharge to the Mississippi River, and <br /> WHEREAS, the City holds a NPDES operating permit (Permit # MN0020788) for the <br /> Plant as a part of the national and state disposal permit program administered by the Minnesota <br /> Pollution Control Agency under the Clean Water Act, as amended (33 USC 1251), MSA <br /> Chapters 115 and 116, and Minnesota Rules Chapter 7701, and <br /> WHEREAS, Elk River Landfill operates a solid waste facility which discharges leachate <br /> into the City's municipal sanitary sewer system for treatment at the City's Plant, and <br /> WHEREAS, under definitions set forth in the NPDES operating permit for the Plant, Elk <br /> River Landfill is defined as a significant industrial user, and <br /> WHEREAS, the City is required to prepare and execute an industrial wastewater <br /> treatment agreement with all significant industrial users. <br /> NOW THEREFORE in consideration of the foregoing premises and the mutual <br /> covenants and promises hereinafter set forth the parties hereto agree as follows: <br /> 1 <br /> 34899386.2 10/04/2019 <br />
