FURTHER, THE CITY RESERVES THE RIGHT TO <br />STOP WORK AUTHORIZED IN ITS APPROVAL UNTIL THE SITE IS <br />APPROPRIATELY INVESTIGATED AND WORK IS AUTHORIZED. <br /> <br /> <br />7.CASH SHALL BE PAID FOR PARK DEDICATION. <br /> <br /> <br />8.THE CITY COUNCIL ACKNOWLEDGES THAT CERTAIN PORTIONS <br />OF THE BUILDING WILL ENCROACH INTO THE PUBLIC RIGHT <br />OF WAY. THESE ENCROACHMENTS WILL BE ALLOWED FOR <br />FOOTINGS, CANOPIES, AND DOOR SWINGS INTO THE PUBLIC <br />RIGHT OF WAY, AS THE CITY IS AUTHORIZING ZERO LOT LINE <br />CONSTRUCTION TO FURTHER THE TRADITIONAL <br />DEVELOPMENT PATTERN OF THE DOWNTOWN AREA. THE <br />BUILDING OWNER SHALL MAINTAIN LIABILITY INSURANCE TO <br />INDEMNIFY THE CITY FOR ALLOWING THESE <br />ENCROACHMENTS. <br /> <br />MOTION CARRIED 3-1. Councilmember Farber opposed. (Councilmember Farber is opposed <br />to the Jackson and Bluff Block projects.) <br /> <br />7.5. Update on Upland Avenue Sidewalk Issue <br /> <br /> City Engineer Terry Maurer stated he contacted the five property owners on the west side of <br />Upland Avenue to see how interested they were in adding a sidewalk along their property. <br />He stated only one property owner expressed opposition: this owner’s home would be the <br />closest to the sidewalk and he would lose one tree. <br /> <br /> Mr. Raivala, 441 Upland Avenue- Stated he is opposed to the sidewalk installation on <br />Upland Avenue. He is concerned about who would have to maintain the sidewalk and the <br />loss of three trees, which act as a buffer to the noise from Highway 10. <br /> <br />Mr. Maurer stated that since Mr. Raivala’s home would be very close to the sidewalk, he <br />suggested that the city could add a sidewalk to his porch entry at no additional expense. <br /> <br /> Rob Grandros, 1706 Main Street-Stated he is concerned about the sidewalk maintenance on <br />his property as the city snowplow trucks tend to pile a lot of snow in this area. He is also <br />concerned about losing the old growth trees in the neighborhood. <br /> <br /> Mr. Maurer stated the maintenance of the sidewalk would be the homeowner’s <br />responsibility. He questioned the Street Department regarding the snow piled near Mr. <br />Grandros’s property. <br /> <br /> Mark Thompson, Assistant Street Superintendent stated that Main Street and Upland <br />Avenue are routes that have more traffic and therefore does get plowed more frequently by <br />the city. He stated that typically on these types of routes, especially where the sidewalk is <br />behind the curb, the city would maintain the sidewalk using the sidewalk plow. <br /> <br /> <br />
