~ REGULAR SEJvlI-HONTHLY H.SETING OF THE VILLAGE COUNCIL OF ELK RIVER HELD IN THE COUNCIL CHAMBER OF THE VILLAGE OFFICE BLDG. December 4, 1972 at 7:30 pm. The regular semi-monthly meeting of the Elk River Village Council was called to order by Mayor Bartelt on December 4, 1972 at 7:30 pm. in the Council ~hambers of the Village Office Building. Members were present as follows: Mayor Bartelt, Councilmen Syring, Otto, Hudson, and Konop. Village Attorney John MacGibbon was in attendence. The minutes of the November 20, 1972 regular meeting were mailed. All members received and read the minutes there were no additions or correction and the minutes were approved as mailed. Councilman Robert Syring presented to the Council his projected sewer rates based on annual water usage. The Council reviewed and accepted the report as presented with the exception that businesses that use water for air conditioning (Rons IGA & Barneys Cafe) sewer rate will be ba~ed on their winter quarterly water bill. It was agreeable with the Council that these business places that use water cooled air conditioning will be reviewed at a future date, towards curtailing water usage. The Council discussed with Bill Patenaude the sewer line problems regarding Russ Olson. Mr. Patenaude will check further vdth I~rl Hohlen as to who dug up the street for the purpose of obtaining more detailed facts as to who is obligated. Mr. Olson will be contacted by the Utilities inorder that he can file a formal claim. At 8:00 pm. the assessment hearing for the 1972 Street Improvements convened. William Mills Village Engineer in attendance. The assessment rolls for the improvements for Railroad Drive-4th Street & King Avenue North f tracks were reviewed interested property owners in attendance were the Tax Agent represent- ng Burlington Northern, and William Konop representing the Eagles Club. Only objection to the assessment was by the E~gles Club as they felt that 32 feet on the westerly edge of their property should be deleted from the assessment as Schallbergs Garage encrouches on their property at this location. After discussion the Eagles representative withdrew his objection and they will negotiate with Schallbe~. Main Street & King Avenue South of Main Street improvements were reviewed. Richard Gongoll representing 1st National Bank of Elk River was in attendance. Mr. Gongoll voiced no objections to the assessment roll as presented. The Alley between Block 4 and 5 improvements were reviewed no interested property owners were in attendance therefore there were no objections. The Clerk-Treasurer was instructed to invoice Neil Larson $1,543.49 for street construction on 5th Street at the end of Baldwin Avenue in Johnson Addition. As there was no others in attendance opposing the 1972 Street Improvement assessment roll hearing~ it was moved by Councilman Syring and seconded~ by. Councilman Otto that the 1972 Street Improvement Assessment Roll Heari. ng be adjourned. Motionunaminously carried ~ a vote Moved by Councilman Otto and seconded by Councilman Hudson to adopt the Assessment Ro of 4-~ for the 1972 Street Improvements as calculated by the Village Engineer and to certify them to the County Auditor for collection through the annual taxes over a 15 year term. 'l'he interest on the unpaid balance to be 7% to start accuring December 5, 1972. Motion unaminously carried by a vote of 4-0. 1r. Mills reported on the proposed lcw housing apartments proposed Northwest of Proctor ~venue. The present sewer capacity could handle this but any additional housing developments would probably over-tax the present sewer system. He therefore would not recommend without an expansion to the present sewer system. Discussion with y~. Mills and John MacGibbon on applying for Federal grant in 1973 for sewer expansion. The Village is presently 14th on the priority list for outlaying area.
