W WASTE MANAGEMENT 9.1.2 Each Unit Price shall include an amount to cover Contractor's overhead and profit for each separately identified item. 9.1.3 The quantities indicated in the Agreement have been estimated by Owner for contracting and comparison purposes. No Claim shall be made against Owner for any excess or deficiency therein. Payment at the prices stated in the Agreement shall be in full for the completed Unit Price Work, and will cover materials, supplies, labor, tools, machinery and all other expenditures incidental to satisfactory completion of the Unit Price Work, subject only to adjustments for Major Items as set forth in Article 9.1.5. 9.1.4 Owner may increase or decrease (including totally eliminate)quantities of Unit Price Work at any time. Contractor will be entitled to payment only for the actual quantities of items provided at the Unit Prices set forth in the Agreement, subject only to adjustments for Major Items as set forth in Article 9.1.5. 9.1.5 At the request of either Party and subject to the provisions of Article 15 regarding Claims and disputes, the Unit Price for any Major Item shall be equitably adjusted when actual quantity of such Item varies from the estimated quantity for such Item by more than twenty-five percent of the original estimated quantity included in Exhibit A. Such adjustment shall reflect any over or under allocation of overhead and profit in the Item due to the variation in the actual quantity of the item from the estimated quantity. The amount of the adjustment, if any, is subject to Owner's right to audit Contractor's actual costs incurred in completing the Major Item Work. 9.2 Schedule of Values (Lump Sum Work). 9.2.1 For Work contracted on a Lump Sum basis,ten (10)Days before the first Application for Payment, the Contractor shall submit to Owner's Authorized Representative a Schedule of Values allocating the Contract Price to the various portions of the Work, prepared in such form and supported by such data as the Owner's Authorized Representative may require to substantiate its accuracy. This schedule, as approved by the Owner's Authorized Representative, shall be used as a basis for reviewing Contractor's Applications for Payment for Lump Sum Work. 9.2.2 In the event Owner permits a separate line item in the Schedule of Values for mobilization, the maximum percentage that may be allocated for mobilization in the Schedule of Values is ten percent(10%)of the Contract Price. 9.2.3 In the event Owner permits a separate line item in the Schedule of Values for General Conditions, the maximum percentage that may be allocated for General Conditions in the Schedule of Values is ten percent(10%)of the Contract Price. 9.3 Cash Allowances 9.3.1 Contractor shall include in the Contract Price all allowances provided for in the Contract Documents for: .1 services, utility relocations, permits, or other similar costs; and .2 materials and equipment. Items covered by an allowance shall be supplied for the price determined under Article 9.3.2.4 and by such persons or entities as Owner may direct, but Contractor shall not be required to employ persons or entities against which Contractor makes reasonable objection. 9.3.2 Unless otherwise stated in the Contract Documents: .1 materials and equipment under an allowance shall be selected promptly by Owner within the time limits for processing submittals; .2 allowances shall cover the cost to Contractor of services completed or materials and equipment delivered at the Site and all required taxes, less applicable trade discounts; .3 Contractor's costs for administering services, unloading and handling products at the Site, labor, installation costs, overhead, profit, and other expenses contemplated for the allowance shall be included in the Contract Price and not in the allowance; and 28 Jun-17 Ver.2.0
