W <br /> WASTE MANAGEMENT <br /> an RFI response provided by Owner to Contractor within seven (7) Days of Contractor's written request <br /> therefore shall be conclusively deemed to have been furnished with reasonable promptness. <br /> 4.7 Rejection of Work. The Owner's Authorized Representative has authority to reject Work which does not <br /> conform to Contract Documents. <br /> 4.8 Additional Testing. Whenever the Owner's Authorized Representative considers it necessary or <br /> advisable for implementation of the intent of the Contract Documents, Owner's Authorized Representative <br /> has authority to require additional inspection or testing of the Work in accordance with Articles 13.5, <br /> whether or not such Work is fabricated, installed, or completed. <br /> 4.9 Claims. Owner's Authorized Representative shall act on Claims, as described in Article 15. <br /> 4.10 Communications in Agreement Administration. Except as otherwise provided in the Contract <br /> Documents or when direct communications have been specifically authorized by Owner's Authorized <br /> Representative between Contractor and a delegate of Owner's Authorized Representative, Contractor <br /> communication shall be with Owner's Authorized Representative. Communications by and with the <br /> Owner's Design Professional shall be through the Owner's Authorized Representative. Communication <br /> with Subconsultants shall be through the Owner's Authorized Representative. Communications with <br /> Subcontractors and material suppliers shall be through Contractor. Communications by and with <br /> Separate Contractors shall be through the Owner's Authorized Representative. <br /> ARTICLE 5 <br /> Subcontractors and Suppliers <br /> 5.1 Award of Subcontracts <br /> 5.1.1 Promptly following execution of the Agreement and before commencing Work at the Site, <br /> Contractor shall submit in writing to Owner's Authorized Representative a list of Subcontractors <br /> proposed for each portion of the Work with a value of greater than $10,000. The list shall include: <br /> 1 a description of the Work and such other information about such proposed <br /> Subcontractors as the Owner's Authorized Representative may request. <br /> .2 The approximate value of the Subcontract; and <br /> .3 Identification of whether the Subcontractor is a DBE or otherwise certified as a minority, <br /> woman or veteran owned business. <br /> 5.1.2 The Owner's Authorized Representative will reply to Contractor in writing stating whether or not <br /> Owner, after due investigation, has reasonable objection to any such proposed person or entity. <br /> Failure of the Owner's Authorized Representative to reply within seven (7) Days shall constitute <br /> notice of no reasonable objection. <br /> 5.1.3 Contractor shall not contract with a proposed Subcontractor to whom the Owner's Authorized <br /> Representative has made reasonable and timely objection. <br /> 5.1.4 If the Owner's Authorized Representative has reasonable objection to a person or entity proposed <br /> by Contractor,the Contractor shall propose another to whom Owner has no reasonable objection. <br /> 5.1.5 If the Contractor demonstrates that its execution of the Agreement was based on a bid from a <br /> Subcontractor rejected by the Owner and that there was no reason to anticipate such objection, <br /> the Contract Price will be adjusted by the difference in the actual cost caused by such substitution <br /> of a Subcontractor, and an appropriate Change Order will be issued. <br /> 5.1.6 Contractor shall execute contracts with Suppliers and approved Subcontractors within thirty (30) <br /> Days after the date of execution of the Agreement. <br /> 5.1.7 Contractor shall notify Owner's Authorized Representative of any proposed change of a <br /> Subcontractor previously accepted by Owner. <br /> 5.1.8 Contractor shall not be required to employ any Subcontractor, Supplier, or other persons or <br /> entities against whom Contractor has reasonable objection. <br /> 22 Jun-17 <br /> Ver.2.0 <br />
