W WASTE MANAGEMENT an RFI response provided by Owner to Contractor within seven (7) Days of Contractor's written request therefore shall be conclusively deemed to have been furnished with reasonable promptness. 4.7 Rejection of Work. The Owner's Authorized Representative has authority to reject Work which does not conform to Contract Documents. 4.8 Additional Testing. Whenever the Owner's Authorized Representative considers it necessary or advisable for implementation of the intent of the Contract Documents, Owner's Authorized Representative has authority to require additional inspection or testing of the Work in accordance with Articles 13.5, whether or not such Work is fabricated, installed, or completed. 4.9 Claims. Owner's Authorized Representative shall act on Claims, as described in Article 15. 4.10 Communications in Agreement Administration. Except as otherwise provided in the Contract Documents or when direct communications have been specifically authorized by Owner's Authorized Representative between Contractor and a delegate of Owner's Authorized Representative, Contractor communication shall be with Owner's Authorized Representative. Communications by and with the Owner's Design Professional shall be through the Owner's Authorized Representative. Communication with Subconsultants shall be through the Owner's Authorized Representative. Communications with Subcontractors and material suppliers shall be through Contractor. Communications by and with Separate Contractors shall be through the Owner's Authorized Representative. ARTICLE 5 Subcontractors and Suppliers 5.1 Award of Subcontracts 5.1.1 Promptly following execution of the Agreement and before commencing Work at the Site, Contractor shall submit in writing to Owner's Authorized Representative a list of Subcontractors proposed for each portion of the Work with a value of greater than $10,000. The list shall include: 1 a description of the Work and such other information about such proposed Subcontractors as the Owner's Authorized Representative may request. .2 The approximate value of the Subcontract; and .3 Identification of whether the Subcontractor is a DBE or otherwise certified as a minority, woman or veteran owned business. 5.1.2 The Owner's Authorized Representative will reply to Contractor in writing stating whether or not Owner, after due investigation, has reasonable objection to any such proposed person or entity. Failure of the Owner's Authorized Representative to reply within seven (7) Days shall constitute notice of no reasonable objection. 5.1.3 Contractor shall not contract with a proposed Subcontractor to whom the Owner's Authorized Representative has made reasonable and timely objection. 5.1.4 If the Owner's Authorized Representative has reasonable objection to a person or entity proposed by Contractor,the Contractor shall propose another to whom Owner has no reasonable objection. 5.1.5 If the Contractor demonstrates that its execution of the Agreement was based on a bid from a Subcontractor rejected by the Owner and that there was no reason to anticipate such objection, the Contract Price will be adjusted by the difference in the actual cost caused by such substitution of a Subcontractor, and an appropriate Change Order will be issued. 5.1.6 Contractor shall execute contracts with Suppliers and approved Subcontractors within thirty (30) Days after the date of execution of the Agreement. 5.1.7 Contractor shall notify Owner's Authorized Representative of any proposed change of a Subcontractor previously accepted by Owner. 5.1.8 Contractor shall not be required to employ any Subcontractor, Supplier, or other persons or entities against whom Contractor has reasonable objection. 22 Jun-17 Ver.2.0
