W <br /> WASTE MANAGEMENT <br /> 3.12.2 It is not Contractor's responsibility to ascertain that the Contract Documents are in accordance <br /> with Applicable Laws. However, if Contractor believes or determines any portion of the Contract <br /> Documents are at variance with any Applicable Laws,Contractor shall promptly notify the Owner's <br /> Authorized Representative in writing. If Owner agrees, any necessary changes shall be <br /> accomplished by an appropriate Amendment. <br /> 3.12.3 If Contractor performs Work knowing it to be contrary Applicable Laws without giving advance <br /> notice, in writing, to Owner, Contractor shall assume full responsibility for such Work and shall <br /> bear and pay all direct and indirect costs or correcting the Work to conform to Applicable Laws <br /> and shall indemnify the Owner against the consequences thereof as provided in this Article 3. <br /> 3.13 Concealed Conditions <br /> 3.13.1 If Contractor encounters conditions at the Site that are: (i)subsurface or other concealed physical <br /> conditions that differ materially from those indicated in the Contract Documents and that could <br /> not be ascertained from the survey and site data made available by Owner; or (ii) unknown <br /> physical conditions of an unusual nature that differ materially from those ordinarily found to exist <br /> and generally recognized as inherent in construction of the character inherent to the Work and <br /> that could not be ascertained from the survey and site data made available by owner, then <br /> Contractor shall notify Owner's Authorized Representative, in writing, of the presence of such <br /> conditions not later than seven (7) Days after the Contractor's first observance of such conditions <br /> and in any event before such conditions are disturbed. Owner will investigate the conditions and <br /> notify Contractor in writing of Owner's determination concerning whether the conditions materially <br /> differ. If Owner agrees that the conditions material differ as set forth above, a Amendment will <br /> be issued to equitably adjust the Contract Price and Contract Time on account of such materially <br /> different conditions. If Contractor disagrees with Owner's assessment of the conditions, <br /> Contractor may submit a Claim as provided in Article 15 of these General Conditions. <br /> Contractor's failure to give timely notice under this Article of any materially different conditions <br /> encountered by Contractor before such conditions are disturbed shall constitute a waiver of <br /> Contractor's right to make any Claim for additional compensation or time related to the presence <br /> of such conditions. <br /> 3.13.2 Should Contractor encounter human remains, burial grounds, archeological sites, wetlands or <br /> other conditions where Contractor is legally obligated to cease working and not indicated in the <br /> Contract Documents, Contractor shall suspend any Work that would affect them and give <br /> immediate notice to Owner's Authorized Representative in writing of the conditions and <br /> suspension. Contractor shall continue to suspend such affected operations until instructed <br /> otherwise by Owner. Within fourteen (14) Days of resumption of the affected operations, <br /> Contractor may submit a Claim to Owner for an equitable adjustment of the Contract Price and <br /> Contract Time related to the presence of such conditions. <br /> 3.14 Construction Schedules <br /> 3.14.1 Promptly following execution of the Agreement and no later than seven (7) Days prior to the first <br /> scheduled job progress meeting between Owner and Contractor, Contractor shall prepare and <br /> submit the Construction Schedule for the Owner's Authorized Representative's review. The <br /> Construction Schedule shall reflect the minimum time required to complete the Project, not to <br /> exceed the allowed Contract Time, and shall be in a format, method and level of detail acceptable <br /> to Owner. The Construction Schedule shall be related to the entire Project to the extent required <br /> by the Contract Documents and shall provide for expeditious and practicable execution of the <br /> Work. <br /> 3.14.2 Contractor shall prepare, keep current, and submit for Owner's Authorized Representative's <br /> approval with the Construction Schedule, a schedule of submittals which is coordinated with the <br /> Construction Schedule if such submittals are not included as activities in the Construction <br /> Schedule. <br /> 3.14.3 Contractor shall update or revise the Construction Schedule at appropriate intervals, not less than <br /> monthly, and as required by conditions of the Work and the Project. Each such update or revision <br /> shall reflect Contractor's approved plan to complete the Work within the Contract Time. <br /> 14 Jun-17 <br /> Ver.2.0 <br />
