<br /> 1.5.27 Furnish. Supply, pay for, and deliver to the Site, ready for unloading, unpacking, assembly, and
<br /> installation.
<br /> 1.5.28 General Conditions.These Standard General Conditions for Construction, a part of the Conditions
<br /> of the Agreement and which are incorporated into the Agreement as part of the Contract
<br /> Documents.
<br /> 1.5.29 General Requirements. The sections of the Specifications, if any, which specify administrative
<br /> and procedural requirements and temporary facilities required for the Project.
<br /> 1.5.30 Governmental Authorities. Any governmental or quasi-governmental courts, boards, agencies,
<br /> or other authorities having jurisdiction over the Project, the Contract Documents or the Parties,
<br /> including without limitation jurisdiction over any required inspections or approvals of the Work or
<br /> any portion thereof.
<br /> 1.5.31 Hazardous Materials. Any flammables, explosives, radioactive materials, petroleum-based
<br /> materials exceeding applicable federal, state, or local regulatory limits, asbestos, polychlorinated
<br /> biphenyl (PCB), and other toxic substances or related materials, including without limitation
<br /> substances defined as "hazardous wastes," "hazardous materials," or"toxic substances," in the
<br /> Comprehensive Response, Compensation and Liability Act of 1980, as amended, 42 U.S.C.
<br /> ARTICLE 9601 et seq.; the Resource Conservation and Recovery Act, 42 U.S.C.ARTICLE 2601,
<br /> et seq.; and any other Applicable Laws, including Environmental Laws, and all amendments and
<br /> revisions thereto or as otherwise defined as a pollutant or contaminant under Applicable Laws,
<br /> including Environmental Laws.
<br /> 1.5.32 Holiday. Any Day established by Owner as a holiday.
<br /> 1.5.33 Indemnitees. Those parties that are indemnified by Contractor under the Agreement, including
<br /> Owner, Owner's affiliates, Owner's Design Professional, Subconsultants and their respective
<br /> officers, directors, shareholders, employees, agents, legal representatives, successors, and
<br /> assigns.
<br /> 1.5.34 Instruments of Service. Representations, in any medium of expression now known or later
<br /> developed, of the tangible and intangible creative work prepared by the Owner, Owner's Design
<br /> Professional or their consultants under any professional services agreements with the Owner.
<br /> Instruments of Service may include, without limitation, studies, surveys, models, CAD files,
<br /> building information models(BIM),sketches,drawings,specifications, and other similar materials.
<br /> 1.5.35 Install. Unload, unpack, assemble, erect, place, anchor, apply, work to dimension, finish, cure,
<br /> clean, protect, and similar operations.
<br /> 1.5.36 Liens. Any and all claims of mechanics' or materialmans' liens under any Applicable Laws,
<br /> payment Bond claims, security interests or encumbrances by any person or entity against the
<br /> Work, Project, Site or any materials or equipment incorporated or to be incorporated therein or
<br /> used upon the Site.
<br /> 1.5.37 Lump Sum. The single amounts stated in Exhibit A to the Agreement for completion of all Work
<br /> required by the Contract Documents or for any designated portions of the Work.
<br /> 1.5.38 Major Item. An individual, measurable item of Work Listed in Exhibit A to the Agreement where
<br /> the total price for the item is based on (i) a Unit Price multiplied by an estimated quantity and (ii)
<br /> the total price for the item is greater than or equal to ten percent (10%)of the Contract Price as
<br /> of the Effective Date.
<br /> 1.5.39 Notice of Intent to Award. The written notice by Owner to the apparent successful bidder stating
<br /> that, upon compliance by the bidder with the conditions enumerated in the Notice, Owner intends
<br /> to award and enter into a contract for the Project with the recipient as Contractor.
<br /> 1.5.40 Notice to Proceed. The written notice by Owner to Contractor fixing the Date of Commencement
<br /> unless specified in the Agreement and any conditions regarding commencement of construction
<br /> at the Site.
