W <br /> WASTE MANAGEMENT <br /> 1.5.6 Bonds. Contractor's performance bond, payment bond, maintenance bond, and/or other <br /> instruments of surety to the extent required by the Agreement. <br /> 1.5.7 CQA Consultant. The individual or other legal entity who is under contract to Owner to provide <br /> construction quality assurance inspections under the direction of the Owner's Authorized <br /> Representative and/or as required by Applicable Laws. The responsibilities and duties of the <br /> CQA Consultant are set forth in the Specifications. The term CQA Consultant includes the CQA <br /> Consultant's Authorized Representative. When a CQA Consultant is not employed by Owner to <br /> inspect the Work, Owner's Authorized Representative or his designee will perform the duties and <br /> responsibilities designated in the Contract Documents for the CQA Consultant, in addition to his <br /> usual duties. <br /> 1.5.8 Change Order. A written Amendment to the Agreement prepared by Owner's Authorized <br /> Representative and signed and approved by Owner and Contractor that may include, but is not <br /> limited to,alterations,deviations, additions to,or deletions from the Agreement which are required <br /> for the proper completion of the Work as further described in Article 7 of these General Conditions. <br /> 1.5.9 Claim. A demand or assertion by Contractor seeking, as a matter of right, adjustment or <br /> interpretation of the terms of the Agreement, payment of money, extension of time, or other relief <br /> with respect to the terms or conditions of the Agreement. The term Claim also includes other <br /> disputes and matters in question between Owner and the Contractor arising out of or relating to <br /> the Agreement or a question of fact or law arising out of or related to the Agreement or the Work <br /> to be performed by Contractor. <br /> 1.5.10 Conditions of the Agreement. These Standard General Conditions for Construction and the <br /> Supplementary Conditions, if any. The Conditions of the Agreement are part of the Contract <br /> Documents and define certain rights, responsibilities, and relationships of the Parties and others <br /> involved in performance of the Work. <br /> 1.5.11 Construction Change Directive. A written order prepared by Owner directing a change in the <br /> Work and stating a proposed basis for adjustment, if any, in the Contract Price or Contract Time, <br /> or both, as further described in Article 7 of these General Conditions. <br /> 1.5.12 Construction Schedule. A schedule for construction and completion of the Work prepared by <br /> Contractor and approved by Owner, which includes, without limitation, activity sequences and <br /> durations, milestone dates for receipt and approval of pertinent information, preparation and <br /> processing of shop drawings and samples, delivery of materials or equipment requiring long-lead- <br /> time procurement, Owner's occupancy requirements, a proposed Substantial Completion date <br /> and any other items identified or required by Owner to convey how the Project is to be completed. <br /> 1.5.13 Contract Documents. The Agreement, the Exhibits thereto and Conditions of the Agreement, as <br /> enumerated in Article 8 of the Agreement,together with all Amendments issued after the Effective <br /> Date. <br /> 1.5.14 Contract Price. The Contract Price is the amount stated in Exhibit A to the Agreement and, <br /> including authorized Amendments, is the total amount payable by Owner to Contractor for <br /> performance of the Work required by the Contract Documents. <br /> 1.5.15 Contract Time. The time allotted for Contractor's performance of the Work and set forth in the <br /> Agreement, measured from the Date of Commencement to the Date of Substantial Completion, <br /> as adjusted by any Amendments. <br /> 1.5.16 Contractor. The person or entity identified as Contractor in the Agreement. Contractor is referred <br /> to throughout the Contract Documents as singular in number. Contractor shall be lawfully <br /> licensed to perform the Work in the jurisdiction where the Project is located. Contractor shall <br /> designate an Authorized Representative who shall have the authority to bind Contractor with <br /> respect to all matters under the Agreement.
