SECTION 02370-EROSION&SEDIMENT CONTROL <br /> PART 1-- GENERAL <br /> 1.1 SUMMARY <br /> A. This section covers the furnishing of all labor, materials,tools,equipment and performances of all work and <br /> services necessary or incidental to storm water management as indicated on the plans,as specified herein <br /> or as directed by the Engineer. <br /> B. The Contractor and Owner shall identify a person(s) knowledgeable and experienced in the application of <br /> erosion and sediment control Best Management Practices(BMPs)who will oversee the implementation of <br /> the SWPPP. <br /> C. Minnesota Pollution Control Agency(MPCA)-General Storm Water Permit for Construction Activity(MN <br /> R100001) <br /> 1. The Owner has developed a Storm Water Pollution Prevention Plan(SWPPP) in accordance with Part <br /> III (Storm Water Discharge Design Requirements)of the National Pollutant Discharge Elimination <br /> System (NPDES)/State Disposal System Permit. The SWPPP is included in the project plans. <br /> 2. As a condition of the Award,the Contractor shall be a co-permittee and assume the role of"Operator" <br /> under the NPDES Permit. <br /> 3. The Contractor will initiate the permit application and pay the required fee and submit the NPDES <br /> Permit. <br /> 4. Permittee(s)shall ensure that their SWPPP meets all terms and conditions of this permit and that their <br /> activities do not render ineffective another party's erosion prevention and sediment control BMPs. <br /> 5. The Contractor shall maintain copies of the SWPPP on the project site at all times and comply with all <br /> provisions contained therein, including performing the required inspections of the erosion control <br /> devices and maintaining an Inspector's Log for the MPCA Storm Water Permit. An Inspector's Log form <br /> is attached at the end of this Section. <br /> 6. The Contractor shall be responsible for keeping the on-site SWPPP documents current and updated to <br /> reflect changing conditions as construction progresses. <br /> 7. Process Summary: <br /> (a) Owner issues Notice of Award to Contractor. <br /> (b) The Contractor shall review the SWPPP and may propose changes or a new SWPPP to the Engineer <br /> and Owner for review,comment,and Authorization. Changes may be recommended by the <br /> Contractor, Engineer,and/or Owner at any time during the construction period to address <br /> changing conditions. <br /> (1) The responsibility for SWPPP amendments proposed by the Contractor lies with the <br /> Contractor. If the Engineer and/or Owner authorize the revisions with no exception taken, <br /> such action shall not absolve the responsibilities of the Contractor in any way. <br /> (2) During the review and modification period,on-site Erosion Control shall comply with or <br /> exceed the current SWPPP. Pending review by the Engineer and/or Owner shall not alleviate <br /> the Contractor's responsibility to install necessary BMPs to address site issues. <br /> (3) Once a SWPPP is modified and/or amended,the Contractor shall distribute new copies to the <br /> Owner,the Engineer,the on-site project supervisor and the resident project representative. <br /> (c) Within 7 days of acknowledgement of the Notice of Award by the Contractor,the Contractor shall <br /> submit the On-line Stormwater Permit Application to the MPCA. <br /> (d) No earth disturbing work shall begin until the permit coverage date shown on the Coverage Card <br /> issued by the MPCA. <br /> Elk River Landfill, Inc. -R16.115896 EROSION&SEDIMENT CONTROL <br /> March 2019 PAGE 02370-1 <br /> V121917©Bolton&Menk,Inc.2018,All Rights Reserved <br />
