1. If contaminated soils are encountered and not disturbed by the project design or the Contractor's <br /> activities,the Contractor shall notify the Owner,the Engineer and all appropriate agencies. The <br /> Contractor may then proceed with its work, however, no permanent construction is permitted which <br /> could limit access to the area until releases have been granted from the appropriate authorities and a <br /> mitigation plan is developed. <br /> 2. The Contractor shall cooperate with the authorities to determine the extent of the contamination. <br /> 3. All efforts and delays to the Contractor's work shall be considered incidental. <br /> D. CONTAMINATED SOILS ENCOUNTERED-WITH DISTURBANCE OR PROPOSED DISTURBANCE <br /> 1. Immediately notify the Owner and the Engineer. <br /> 2. Cooperate with the Engineer's Soils Consultant to determine the extent and type of contamination <br /> present. <br /> 3. If disturbance has already occurred,the Contractor shall: <br /> (a) Immediately notify the Owner,the Engineer and all appropriate agencies, (including the Minnesota <br /> Duty Officer for spills 800-422-0798, if appropriate). <br /> (b) Isolate and secure the area. <br /> (c) Make a determination of the potential risks of fire,fumes,spreading the contamination,etc. <br /> (d) Notify neighboring residents, if the potential is significant. <br /> 4. The Contractor shall then, participate in the development of a mitigation plan, if asked,and be <br /> available to conduct the mitigation. <br /> E. BACKFILLING OPERATIONS <br /> 1. Once the tank and mitigated soils have been removed,the site shall be backfilled with granular <br /> material obtained from other on-site excavations and on-site stockpiles as directed by Owner. <br /> 2. All backfill shall be compacted in accordance with the Quality Compaction Method. <br /> F. DISPOSAL <br /> 1.
