DECLARATION OF COVENANTS CONDITIONS <br />AND RESTICTIONS <br />HILLTOP WOODS ESTATES,ELK RIVER, MN. <br />LOTS i.2,3.5,6,7,8. <br />Section 1, I,IDIVDUAUL LOT MAINTENANCE. <br />In the event that any Owner violates any covenant or fails to perform any <br />condition contained in this Declaration, the Developer -may perform the act <br />remove the defect or correct the violation upon thirty -(30) days written <br />notice to the Owner. If the Developer so ,•Pbts -on • behlf of an Owner, the <br />Developer may levy an assessment against the Lot for the.cost"of the <br />performance or correction. <br />Section 2. MAINTENANCE AND REPAIR <br />In order to preserve the uniform and high -standard appearan&e'46f 'the <br />property, each Owner undertakes responsibility foi maintenance and" repair <br />of the exterior of his Living Unit, private yard area and private driveway <br />on the Lot. CONSTRUCTION. REQUIREMENTS. <br />A) Allexterior construction and painting must be done by the date of <br />w4upancy. Deviations for any reason must receive the prior written approval <br />of the Declarant. <br />B) Mailboxes and posts shall be of a standard design.,"_- <br />C) Decks and/b',rpatios must be -completed prior to occupancy unless <br />delay is approved in writing by the Declarant. <br />D) All houses must have a minimum exterior, roof pitch of 5 to 12 and ali,, <br />roofs must have a minimum roof overhang of one -foot on the gable and <br />.f <br />18 inches on the soffit. <br />K:,Chimney chases shall be brick or of a material identical to the house <br />siding.
