Theapplicant is seeking aCUP toamendthe approvedPUD <br />development plan to addan automated expresslanefor onlineorderpickup. <br />Theapplicant isrequestingthePUD agreement beamended toallowfora four-footsetbackalongthe <br />northpropertylineofthesubjectparceltoallowtheconstructionoftheproposeddrivelane, retaining <br />wall, andfence/barrierwall. <br />Staffhasno concernswiththisrequest and onlysupportsthedrivelane, retainingwall, andfence/barrier <br />wallbeing setback asshownonthe siteplan. Nobuilding structure, otherthanthecovereddrive-thru, <br />canbe located closer tothenorth property line thanwhatiscurrently constructed onsite. <br />Applicable Regulation <br />Inapproving aConditional UsePermit, thePlanningCommission and CityCouncilmayimpose such <br />specificconditions withregardto thedevelopment oroperationofthe proposeduseas itconsiders <br />necessarytosatisfythe seven standardssetforthin Section 30-654 inorder topromote compatibility <br />withandminimizeany potentiallyadverseeffects uponadjacentproperties, theneighborhood or thecity. <br />Theissuance of aConditional UsePermitcanbeordered onlyifthe useatthe proposedlocation: <br />1.
