Request by SlM Development for Conditional Use Permit, Case No. CD 04-16 <br /> <br />Senior Planner Scott Harlicker explained that SlM Development is requesting a conditional <br />use permit to construct a 7,900 square foot multi-tenant building including a dass 2 <br />restaurant (Taco John's) and retail space. Mr. Harlicker reviewed the site plan, parking and <br />access, pedestrian access, landscaping and building elevations. Staff recommends approval <br />of the request with the four conditions listed in the staff report dated May 25, 2004. <br /> <br />Commissioner Pederson asked what signage would be allowed. Mr. Harlicker stated that <br />one wall sign is permitted per tenant space, and one monument sign for the site. <br /> <br />Chair Ropp opened the public hearing. <br /> <br />Jay Tutt, representing STM Development, stated that in lieu of a monument sign, the <br />PUD Agreement was amended for the Panera site to allow two wall signs for the center <br />tenants and 3 signs for the end tenants. He stated that they would ask that the PUD be <br />amended to include the same signage for this site. Ms. McPherson explained that an <br />amendment could not be considered as part of this request, due to publication and <br />notification requirements and that the applicant would need to apply separately for an <br />amendment to address signage. Mr. Tutt asked if the process for the conditional use permit <br />could move forward and application for the amendment be made separately. Ms. <br />McPherson stated yes. <br /> <br />Mr. Harlicker asked for clarification on the exterior materials and colors. Mr. Tutt reviewed <br />the materials and asked if colors needed to be chosen before the City Council consideration. <br />Mr. Harlicker stated that this information should be submitted to staff by in time to be <br />reviewed prior to the City Council meeting <br /> <br />Commissioner Offerman asked how many signs are permitted in the PUD agreement. Ms. <br />McPherson stated that one wall sign per tenant and one monument sign for the site is <br />permitted. <br /> <br />Commissioner Stevens stated that he felt the site was unique in that the majority of the <br />traffic would approach the site from the rear. He felt there should be a better way to present <br />the building on three sides. <br /> <br />Commissioner Offerman stated that he shared Commissioner Steven's concerns and felt that <br />additional signage and building materials could be used to improve the building's appearance <br />on the three sides of the building. <br />
