Request by Lisa Shields- Ergen for a Conditional Use Permit to Operate a Montessori School <br /> <br />Staff report by Chris Leeseberg. Lisa Shields-Ergen requests a conditional use permit to <br />operate a Montessori School at 508 Freeport Avenue (Lot 5, Block 1 Elk River Plaza 2nd <br />Addition). Mr. Leeseberg reviewed the site conditions, parking and circulation, staffing, <br />number of students, and hours of operation. Staff recommends approval of the request with <br />the six conditions listed in the staff report. <br /> <br />Chair Pederson opened the public hearing. There being no public comment, Chair Pederson <br />closed the public hearing. <br /> <br />Commissioner Jenson questioned why Condition #2 stated a maximum of 55 students, <br />when the applicant states she will have 45 students. Mr. Leeseberg stated that a limit of 55 <br />students would allow some growth. <br /> <br />Chair Pederson asked if the applicant was willing to provide the striping of the crosswalk. <br />Ms. Shields-Ergen stated that the State of Minnesota does not require striping. She stated <br />that she plans to use cones and signage to designate the walkway from the school to the play <br />area. Chair Pederson stated that this requirement was made for another school of this type. <br /> <br />Ms. Shields- Ergen stated that since speaking with the owner of the Karate Studio she feels <br />that the parking will be adequate for the last hour of the school day. She noted that <br />employees of the businesses have been parking in the front and will now be required to park <br />in the back of the building, which will provide more customer parking. <br /> <br />Commissioner Jenson stated that he feels the location of the playground area is a poor <br />choice and that he is not comfortable with the students crossing a parking lot to access the <br />playground. <br /> <br />COMMISSIONER FRANZ MOVED TO RECOMMEND APPROVAL OF THE <br />REQUEST BY LISA SHIELDS-ERGEN FORA CONDITIONAL USE PERMIT <br />TO OPERATE A MONTESSORI SCHOOL, CASE NO. CU 03-13 WITH THE <br />FOLLOWING CONDITIONS: <br /> <br />1. IF MORE THAN A TOTAL OF 10 EMPLOYEES ARE TO BE ON SITE, <br />THE APPLICANT SHALL APPLY FORAN AMENDMENT TO THE <br />CONDITIONAL USE PERMIT. <br />2. IF MORE THAN A TOTAL OF 55 STUDENTS ARE TO BE ENROLLED, <br />THE APPLICANT SHALL APPLY FORAN AMENDMENT TO THE <br />CONDITIONAL USE PERMIT. <br />3. IF THE LOCATION OF THE PLAY AREA IS MOVED, THE APPLICANT <br />SHALL APPLY FORAN AMENDMENT TO THE CONDITIONAL USE <br />PERMIT. <br />4. CLIENTS SHALL ABIDE BY THE DROP-OFF AND PICK-UP SCHEDULE <br />SET BY THE OPERATOR. <br />
