THE <br />MOTION CARRIED 7-0. <br /> <br />5. <br /> <br />Planning Commission Representative to Attend April City Council Meeting <br /> <br />Chair Pederson will attend the Apri115, 2002 City Council meeting. <br /> <br />6.1. Request by Mike & Monica Johnson for Conditional Use Permit for Private Kennel. Public <br />Hearing - Case No. CU 02-06 <br /> <br />Staff report by Planner Chris Leeseberg. Mike and Monica Johnson request a conditional <br />use permit for a private kennel at 13926 200th Avenue NW. Mr. Leeseberg explained that <br />the J ohnsons have two dogs which are kept indoors and two dogs that are kept outdoors. <br /> <br />Commissioner Franz asked if the private kennel ordinance allows breeding but not selling, <br />since it states "no on-site commercial activities, such as breeding, boarding or selling." <br />Commissioner Baker asked if it would be considered a "commercial use" if breeding <br />occurred and the applicants put an ad in the paper to sell the puppies. Mr. Beck felt that <br />technically, this would be considered "commercial". <br /> <br />Discussion followed regarding placing a restriction on the license. Commissioner Mesich <br />felt it would be unfair to restrict the J ohnsons from raising and selling a litter of puppies, <br />since this is a right enjoyed by other citizens in the City. He noted that the ordinance states <br />that residents are allowed up to 3 dogs over the age of six months, and puppies could be <br />sold before they reached six months. <br /> <br />e <br /> <br />Chair Pederson opened the public hearing. <br /> <br />Michael Johnson, applicant, explained that they would not be breeding any of the dogs <br />since the two outdoor dogs are neutered males, and the two indoor dogs are spayed females. <br /> <br />Chair Pederson asked if the dogs were large dogs and if so, could they jump the fence? Mr. <br />Johnson stated that they are large dogs and that one of them has jumped the fence. He <br />stated that he will be increasing the 4 foot high fence to 5 feet. He noted that his neighbors <br />also have dogs and that his closest neighbor has 5 huskies. <br /> <br />Commissioner Baker asked how large Mr. Johnson's lot is. Mr. Johnson stated that he has <br />approximately 2 3,4 acres. Commissioner Baker asked if barking was an issue. Mr. Johnson <br />stated that the dogs usually only bark when deer come close by. <br /> <br />Commissioner Mesich suggested that Condition #2 be modified to include 4 dogs" over the <br />age of six months" . <br /> <br />There being no further public comment, Chair Pederson closed the public hearing. <br /> <br />COMMISSIONER FRANZ MOVED TO RECOMMEND APPROVAL OF THE <br />REQUEST BY MIKE AND MONICA JOHNSON FOR A CONDITIONAL USE <br />PERMIT FOR A PRIVATE KENNEL, CASE NO. CU 02-06, WITH THE <br />FOLLOWING CONDITIONS: <br /> <br />e <br /> <br />1. THAT THERE BE NO ON-SITE COMMERCIAL ACTIVITIES SUCH AS <br />BREEDING, BOARDING OR SELLING. <br />
