Theclientshave manygroups <br />toattend andonetoonemeetings withstaff, sotheyarekeptbusy. Someclients will <br />participate inmealpreparation andcleanup. When theyleavethebuilding, theyneedtosign <br />out, soweknowwhere theyaregoingduring thefreetime andwhenthey willbeback. Itis <br />importanttonotewearenotalocked facility, butwewillhavesecuritycamerasattheexits <br />andwilllockthedoorsatnightjustlikeeveryone elsedoes. WillallthepatientsattheElkRiverfacilitybefromElkRiverand therestofSherburne <br />County? <br />ResCare – No, butamajoritywillprobably comefrom thearea. Some willcomefrom other <br />counties suchasBenton Sterns, WrightandAnoka. Dueto thisbeingaprimarilyMedicaid <br />fundedprogram weareunder federal rulesandthoserulesdictate whoweshouldaccept. <br />According totheagreement between Minnesota andtheUSgovernment wemusttakepeople <br />fromanywhere inthestate ofMinnesota. <br />7. Whatarethelegalramifications forthe CityiftheResCareCUPisturned down? <br />CityStaff – Aswehave discussedwiththeCityCouncil in thepast, conditional usesareuses <br />thatare permitted, subjecttoconditions. ACUPfora conditional usecanonlybedeniedif <br />there isalegally sufficientreason forthedenial, andthere isafactual basis tosupport that <br />reason. Failuretomeet thestandards set forthinthe CityCodeforapproval ofaCUPisa <br />legally sufficientreason fordenialoftheCUP. However, theremustbeafactual basisforthe <br />determination thatthestandardisnot met, andthedetermination must bemadebased upon <br />therecord beforetheCity Council – thetestimony andevidencepresented – and noton <br />matters fromoutside therecord. <br />Ineveryinstance when theCityCounciliscontemplatingthedenialofaCUPcitystaff’s <br />recommendationisthattheCouncilmakespecificfindingsoffact, basedontherecord of <br />testimony and evidencesubmittedand presented totheCouncilatthepublichearing, astothe <br />standards thatarenotmet, andthefactualbasis forthedetermination thatthey arenotmet, <br />anddirectstafftoputthosefindingsoffactinaformalresolution ofdenialoftheCUP, for <br />actionbytheCouncil atafuturemeeting. <br />Denial ofaCUPapplicationforreasonsthat arenotlegally sufficientand/ornotsupported by <br />therecordbefore theCouncilwould subject thecitytopotential legalliabilityforthedenial. <br />Themostlikelylegalremedy fortheapplicantwould beapprovaloftheCUPthroughthe <br />courts, potentially withoutconditions. <br />8.
