Applicable Regulation <br />InapprovingaCUP, theCouncil may imposesuchspecificconditions with regardtothedevelopment or <br />operation oftheproposed use asitconsiders necessary tosatisfy thesevenstandards set forthinSection <br />30-654andtherequirementscontainedinthisarticleandtopromotecompatibility withandminimize <br />anypotentially adverse effectsuponadjacent properties, theneighborhood or thecity. <br />TheissuanceofaCUPcanbeordered onlyiftheuseattheproposed location: <br />1. Willnotendanger, injure ordetrimentally affecttheuseandenjoymentofother property in theimmediate vicinityor <br />thepublic health, safety, morals, comfort, convenienceorgeneralwelfareoftheneighborhoodor thecity. <br />Theproposed useisself-contained, regulated bythe StateofMinnesota, anddoesnotgenerate <br />significant traffic. Afterdiscussion withthepolicedepartment, staffdetermined theproposed use <br />doesnotposeasecurity threattothecity. The siteisadjacenttoHighway 10andhasaccesstoa <br />signalized intersection. Mosttrafficgenerated bytheusewillutilizethisintersection. Forthese <br />reasons, along withtheextensive visual screening, theuseisnotexpectedto detrimentallyaffect <br />theuseandenjoymentoftheother propertiesinthearea. <br />Staffdoesnotseeaneedtoimposespecific conditionstosatisfy thisstandard. <br />2. Willbeconsistentwiththecomprehensive plan. <br />Theparcelandsurrounding areaareguided forresidential uses. Cityordinancesallow Institutional <br />UseswithaCUPin allresidential districts. Theuseisconsistentwithourresidential zoning <br />ordinance and isconsistent withtheComprehensive Plan. <br />Staffdoesnotseeaneedtoimposespecific conditionstosatisfy thisstandard. <br />3. Willnotimpedethenormal andorderly development andimprovement ofsurrounding vacantproperty. <br />Surrounding properties arefullydevelopedandusewillnotimpede thenormal andorderly <br />development andimprovement ofsurroundingproperties. <br />Staffdoesnotseeaneedtoimposespecific conditionstosatisfy thisstandard. <br />4. Willbeserved adequately byandwillnotadversely affectessentialpublicfacilitiesandservices including streets, <br />policeandfireprotection, drainage, refusedisposal, water andsewersystems, parks andschools; andwillnot, in <br />particular, create trafficcongestion orinterference withtrafficonadjacentandneighboring public thoroughfares. <br />Thepolicedepartmentreviewedtheproposed useand policerecordsfromothercities withIRTS <br />facilitiesoperated byResCare. Staffdoes notbelievethefacilitywilladversely impactpolice <br />protection. <br />Theuse mayincreasethe sewerandwateruseoftheproperty andtheSAC/WACunits willbere- <br />evaluated at thetimeofbuildingpermitreview. Anyincrease inthenumber ofunits willneedto <br />be paidpriortoissuance ofthe buildingpermit. <br />Staffincluded aconditionaddressingchanges totheSAC/WACcalculations. <br />5.
