Adesignatedsmokingarea outside ofthebuilding mustbeidentifiedonthesite plans. <br />Alternatively, if theCityCouncildoesnotbelievethecriteriaforapprovalof aCUParesatisfied, the <br />Councilshouldmake findingsoffactregardingthecriteriawhich arenotmetanddirectstafftopreparea <br />resolution ofdenialsettingforththeFindings ofFactanddenyingtheCUP, foractiononFebruary 4, <br />2019. Specific reasons fordenialmustbeincluded. <br />Background/Discussion <br />OnDecember17, 2018, theCityCouncil discussedtherequest byResCareMinnesota toestablisha16- <br />bedIntensive Residential Treatment withServices (IRTS) facilityat633Upland AveNW. During public <br />hearingtheresidents asked anumberofquestions regardingResCare’soperationandnoted anumber of <br />concerns aboutpotential impactstopublicsafety. <br />Afterthe public hearingwasclosed, City Councildirected staff toconsult withthe police chiefregarding <br />potentialsafety concerns. Councilalsoasked ResCare toprovide written responses tothequestions <br />providedduringthepublic hearing. <br />Afterthemeeting, staffgathered questionsabout ResCare andtheiroperationfrom residents, City <br />Council, andother staff. Responses tothese questionsareincluded as anattachment.
