FOR PRELIMINARY PLAT APPROVAL (ELK RIVER <br />PLAZA 4TH ADDITION), PUBLIC HEARING CASE NO. P 99-8, WITH THE FOLLOWING <br />CONDITIONS: <br /> <br />1. DRAINAGE AND UTILITY EASEMENT BE SHOWN ON THE PLAT PER ELK RIVER <br />UTILITIES RECOMMENDATION. <br /> <br />2. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. <br /> <br />3. ALL NECESSARY CROSS PARKING AND ACCESS AGREEMENTS BE APPROVED <br />BY THE CITY ATTORNEY AND RECORDED WITH SHERBURNE COUNTY. <br /> <br />COMMISSIONER KUESTER SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />COMMISSIONER MESICH MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY <br />DAVID OLSON FOR A CONDITIONAL USE PERMIT FOR A DRUG STORE (ELK RIVER <br />PLAZA 4TH ADDITION), PUBLIC HEARING CASE NO. CU 99-19, WITH THE FOLLOWING <br />CONDITIONS: <br /> <br />1. WINDOWS AND TREES BE PROVIDED ALONG THE FRONT FACADE. <br /> <br />2. <br /> <br />THE ACCESS BETWEEN BURGER KING AND THE DRIVE- THRU AISLE BE <br />ELIMINATED AND LANDSCAPED. <br /> <br />3. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. <br /> <br />4. THE ELK RIVER PLAZA PUD AGREEMENT BE AMENDED TO ALLOW A 15,000 <br />SQUARE FOOT RETAIL BUILDING AND SIGNAGE AS SHOWN ON THE <br />APPROVED SITE PLAN. <br /> <br />5. ALL WALL SIGNS SHALL REQUIRE A SIGN PERMIT AND COMPLY WITH THE ELK <br />RIVER PLAZA PUD AGREEMENT. <br /> <br />6. THE LANDSCAPE PLAN BE APPROVED BY THE CITY. <br /> <br />7. COORDINATE THE FACADE OF THE DRUG STORE WITH THE CLINIC. <br /> <br />COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />COMMISSIONER KUESTER MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY <br />DAVID OLSON FOR A CONDITIONAL USE PERMIT FOR A RESTAURANT (ELK RIVER <br />PLAZA 4TH ADDITION), PUBLIC HEARING CASE NO. CU 99-20, WITH THE FOLLOWING <br />CONDITIONS: <br /> <br />1. <br /> <br />THE ELK RIVER PLAZA PUD AGREEMENT BE AMENDED TO ALLOW THE 200 SEAT <br />CLASS I RESTAURANT WITH ON-SALE LIQUOR AND 6,444 SQUARE FOOT <br />RETAIL SPACE AS SHOWN ON THE APPROVED SITE PLAN. <br />
