Marshall Concrete Products Request for Amendment to Conditional Use Permit <br />No. CU 96-24 to Construct a Storage Garaqe, Public Hearinq Case No. CU 99-17 <br /> <br />Staff report by Steve Wensman. Marshall Concrete has requested a conditional <br />use permit amendment to allow the construction of a storage building at the site <br />which is located in the northwest corner of the intersection of 213th Avenue and <br />Highway 169. The proposed building will be used to store tools, supplies, resale <br />inventories, and to park equipment. Staff recommends approval of the request. <br /> <br />Chair Cote opened the public hearing. <br /> <br />John Thompson, 2637 Marshall Street, Minneapolis, representing the applicant, <br />indicated that they feel vandalism will be reduced if their equipment can be <br />stored indoors and will also reduce nuisance issues. Mr. Thompson noted that the <br />proposed building will match the exterior of the existing building. <br /> <br />There being no further public comment, Chair Cote closed the public hearing. <br /> <br />COMMISSIONER MESICH MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY <br />MARSHALL CONCRETE FOR A CONDITIONAL USE PERMIT, PUBLIC HEARING CASE NO. <br />CU 99-17, WITH THE FOLLOWING CONDITION: <br /> <br />1. THAT THE BUILDING CONFORM TO THE UNIFORM BUILDING CODE AND ANY <br />CONCERNS OF THE ELK RIVER BUILDING AND ZONING DEPARTMENT. <br /> <br />. <br /> <br />COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />6.15. Heritaqe Landing Development Co. Request for Land Use Amendment to Amend <br />the Urban Service Area, Public Hearina Case No. LU 99-1 <br /> <br />Staff report by Steve Wensman. Heritage Landing Development Co. has <br />requested a land use map amendment to remove property located south of <br />Highway lOWest and west of Waco Street, from the urban service district. Steve <br />explained the consequences of such an action, as outlined in his report to the <br />Planning Commission dated May 25, 1999. <br /> <br />Commissioner Kuester suggested that a condition of approval be added to <br />ensure that the property owners will bear all costs to hook up to city sewer and <br />water, if they change their minds in the future. <br /> <br />Commissioner Mesich asked if the site would support a septic system. Terry <br />Maurer, City Engineer, indicated he has not seen soil borings for the site, but he <br />did not see any reason why it would not support a septic system. <br /> <br />Chair Cote opened the public hearing. <br /> <br />Richard Kincanon, property owner, indicated that he has owned the property for <br />22 years, paid over $60,000 in taxes and has been unable to develop the <br />property. <br /> <br />. <br /> <br />There being no further comments from the public, Chair Cote closed the public <br />hearing. <br />
