<br />. <br /> <br />. <br /> <br />. <br /> <br />City Council Minutes <br />May 2, 2005 <br /> <br />Page 4 <br /> <br />City Attorney Peter Beck stated that once the preliminary plat is approved, the Council only <br />has the right to deny the final plat if it doesn't comply with the requirements set forth by the <br />Council for the preliminary plat. Mr. Beck stated that if the Council chooses to deny the <br />plat, they must have ample findings. <br /> <br />Mayor Klinzing indicated that the preliminary plat was approved 3-2 with two previous <br />members of the Council voting for the plat no longer sitting on the Council. Mayor Klinzing <br />indicated that she will vote for the plat because that was the decision of the previous <br />Council. She did note that the density of the plat has been lowered due to the 20-acre site <br />being donated for public purpose. <br /> <br />MOVED BY COUNCILMEMBER DIETZ AND SECONDED BY <br />COUNCILMEMBER MOTIN TO ADOPT RESOLUTION 05-46 GRANTING <br />FINAL PLAT APPROVAL FOR RIVER PARK, CASE NO. P 04-09 WITH THE <br />FOLLOWING CONDITIONS: <br /> <br />1. A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED <br />OUTLINING THE TERMS AND CONDITIONS OF THE PLAT <br />APPROVAL PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />2. A PLANNED UNIT DEVELOPMENT AGREEMENT BE PREPARED AND <br />EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />3. SURFACE WATER MANAGEMENT FEE BE PAID IN THE AMOUNT <br />REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT PRIOR TO <br />RELEASING THE PLAT FOR RECORDING. <br /> <br />4. A SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE <br />CITY ENGINEER BE PAID PRIOR TO RELEASING THE PLAT FOR <br />RECORDING. <br /> <br />5. WATER ACCESSIBILTY FEES IN THE AMOUNT DETERMINED BY <br />THE CITY BE PAID TO ELK RIVER MUNICIPAL UTILITIES PRIOR TO <br />RELEASING THE PLAT FOR RECORDING. <br /> <br />6. THE SITE (185.61ACRES) SHALL BE ASSESSED FOR TRUNK UTILITIES <br />AT $6,955 PER ACRE FORA TOTAL ASSESSMENT OF $1,290,918.00, LESS <br />CREDIT PROVIDED FOR OVERSIZING FACILITIES IF REQUIRED. <br />SAID ASSESSMENTS SHALL BE LEVIED EQUALLY AGAINST ALL LOTS <br />IN THE PLAT EXCEPT FOR LOTS 8 & 9, BLOCK 1. THE DEVELOPER'S <br />AGREEMENT SHALL REFLECT CREDIT FOR OVERSIZING <br />INFRASTRUCTURE AS DETERMINED BY THE CITY ENGINEER. <br /> <br />7. A LETTER OF CREDIT SHALL BE PROVIDED TO THE CITY IN THE <br />AMOUNT OF 100% OF THE COSTS OF THE PUBLIC IMPROVEMENTS. <br /> <br />8. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING <br />THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE <br />AMOUNT OF 25% OF THE IMPROVEMENT COSTS SHALL BE <br />SUBMITTED TO THE CITY FOR THE PERIOD OF ONE YEAR. <br />
