Requests for Appeal: Contents <br /> A statement of the action(s)being appealed together with any material facts in support of his or <br /> her position; <br /> The signature of all parties and date; <br /> A description and justification of the proposed activity; <br /> A description of the tree(s)to be affected including approximate size, location and specie(s); <br /> Specific reasons for appeal; <br /> A statement outlining the interest of each aggrieved party. <br /> 29. Revocation of License <br /> In the event of any suspension,revocation or denial of a business license by the City pursuant to <br /> Section _,the aggrieved party shall have the right to appeal such suspension or revocation to <br /> the City Council. Any such appeal must be submitted in writing to the Council within thirty(30) <br /> days after the date of suspension or revocation of the license and include: <br /> 30. Appeal of Tree Removal <br /> Any person,aggrieved by the City Forester's decision to remove or not remove the tree may then <br /> apply to the Tree Advisory Committee to overturn the City Forester's decision,except when the <br /> City Forester determines the tree to be a hazard. <br /> 31. Right to Enter Private Property <br /> • <br /> The City Forester or his or her designee has authority to enter onto private property for the <br /> purpose of inspecting a public tree when the tree cannot be adequately inspected from public <br /> property,or for the purpose of inspecting a private tree believed to be a nuisance. <br /> 32. Emergencies <br /> Work may proceed without notice when exigent circumstances exist and work is required to <br /> prevent or mitigate property damage or public safety hazard,or disruption of essential city <br /> services. <br /> A permit shall not be required by government personnel or agencies who remove a tree in the <br /> performance of their official duties during an emergency declared by the Mayor or City Council. <br /> 33. Severability Clause <br /> If any section of the ordinance is found to be invalid or unconstitutional,it does not affect the <br /> validity of remaining sections. <br /> 34. Repeal Clause <br /> The provisions of any ordinance or resolutions or parts or ordinances or resolutions in conflict <br /> herewith are repealed,save and except such ordinances or resolutions or parts of ordinances or <br /> resolutions which provide stricter standards than those provided herein. <br /> 35. Effective Date <br /> This Ordinance is hereby declared to be of immediate necessity for the preservation of public <br /> peace,health, and safety and shall be in full force and effective from and after its passage and <br /> • publication as provided by law. <br /> 22 <br />
