periodical adjustments whenever necessary to prevent damage to trees and shrubs growing in any • <br /> public highway or park. <br /> Any utility company,instead of temporarily removing service wire shall have the option of <br /> pruning or removing such tree under the direction of the City Forester. <br /> Public utility companies may,during periods of emergency,without specific prior permit,install <br /> temporary attachments to trees and make emergency subsurface repairs. <br /> Public utility companies shall notify the City Forester not less than 2 business days in advance of <br /> commencement of pruning on public lands and public rights-of-way for purposes of routine <br /> clearing of electric,telephone,cable television and similar overhead rights of way. <br /> 21. Enforcement <br /> The City Forester is responsible for enforcing the provisions of this ordinance. <br /> 22. Interference <br /> No person shall unreasonably hinder,prevent,delay, or interfere with the City Forester or his or <br /> her agents while engaged in the execution or enforcement of this ordinance. <br /> 23. Violations <br /> Any person who shall injure,damage,or destroy any tree,shrub,vine,hedge,or other plant <br /> situated upon the public right-of-way of any street,alley,sidewalk,or other public place within the <br /> city shall promptly notify the City Forester of such occurrence and shall,within such reasonable <br /> time as specified by the City Forester in an order,repair or replace the damaged vegetation to the <br /> satisfaction of the City Forester. <br /> It is unlawful,prohibited and a misdemeanor for any person to violate the provisions in this • <br /> ordinance, including failure to comply with any notice and decision of the Board of Supervisors <br /> following appeal.The City must be compensated for damage to or the loss of any tree as <br /> determined in accordance with this ordinance. <br /> 24. Separate Violations <br /> Each tree affected by noncompliance with this article shall constitute a separate violation. <br /> Each day a violation is committed or permitted to continue is a separate violation. <br /> The owner of any property where any violation exists,and any builder, contractor,or agent who <br /> may have assisted in the commission of any such violation, shall be guilty of a separate offense. <br /> 25. Assessment of Claim <br /> In the event that a nuisance is not abated by the date specified in the notice,the City Forester is <br /> authorized to cause the abatement of said nuisance. The reasonable cost of such abatement shall <br /> be filed as a lien against the property on which the nuisance was located. In addition,the owner of <br /> the property upon which the nuisance was located shall be subject to prosecution. <br /> 26. Appeals <br /> The City Council shall have the right to review the conduct,acts,and decisions of the Tree <br /> Advisory Committee. Any person may appeal from any ruling or order of the Tree Advisory <br /> Committee to the City Council who may hear the matter and make fmal decisions. <br /> 27. Request for Appeal: Introductory Statements <br /> Any person may appeal any ruling or order of the Tree Advisory Committee to the City Council. • <br /> An appeal must be made in writing,filed with the City Clerks Office and shall contain any and all <br /> 21 <br />
