• i. the prevention of soil erosion or other possible pollution of public <br /> waters, both during and after construction: <br /> ii. the visibility of structures and other facilities as viewed from public <br /> waters is limited. <br /> iii. the site is adequate for water supply and on-site sewage treatment; and <br /> iv. the types,uses and numbers of watercraft that the project will generate <br /> are compatible in relation to the suitability of public waters to safely <br /> accommodate these watercraft. <br /> Findings <br /> If the Planning Commission approves this request it should be with the finding that it <br /> meets the seven standards listed above for a conditional use permit and the four <br /> evaluation criteria list in the city's Shoreland Management Ordinance. If the <br /> recommendation is to deny the request,your findings should include which of the seven <br /> standards have not been met by and why. <br /> Recommendation <br /> MPCA has already approved the request by Elk River Landfill to add demolition debris <br /> over cell DC-3. Sherburne County has indicated that they will also approve this request, <br /> but are waiting for the City of Elk River to react to it. With the following conditions, <br /> • staff believes that the Landfill's request can meet the standards listed above and is <br /> recommending approval: <br /> 1. That this approval is conditioned on the recommendations contained in Matt <br /> Ledvina's letter, dated October 18, 2001. <br /> 2. That Sections 2.) (03) (b) of the Landfill's CUP and Solid Waste Facility License be <br /> amended to read: "The demolition debris landfill cell DC-3 shall be located and <br /> operated as shown on the June 2001 Permit Application and August 2001 revisions <br /> submitted by the Permittee with city staff approving and having the authority to <br /> make decisions on the technical issues involved." <br /> 3. That landscaping and berms shall be installed according to the plans submitted by <br /> the Permittee,dated 10/16/01,including revisions as directed by the Elk River City <br /> Council. <br /> • <br />
