<br />o <br /> <br />o <br /> <br />o <br /> <br />REGULAR SEMI-MONTHLY MEETING OF THE <br />CITY COUNCIL OF ELK RIVER <br />HELD IN THE COUNCIL CHAMBERS OF THE CITY OFFICE BLDG. <br />April 3, 1978 at 7:30 P.M. <br /> <br />Members prese~t: Mayor Madsen, Councilmembers otto, Toth and Duitsman. <br /> <br />Moved by Councilmember Toth and seconded by Councilmember Duitsman approving <br />the minutes of the March 20, 1978 meeting as there were no additions or <br />corrections, therefore were approved as printed. Motion unanimously carried <br />by a vote of 3-0. <br /> <br />Mr. David W.Collins and Attorney representing North Central Public Services <br />met with the Council requesting City Council approval in renewing the ordin- <br />ance granting a non-exclusive franchise to erect, construct, reconstruct, <br />maintain, and operate within the City of Elk River a gas distribution system <br />for a 25 year period. <br /> <br />Moved by Councilmember Otto and seconded by Councilmember Toth granting the <br />renewal of a 25 year ordinance granting a non-exclusive franchise to erect, <br />construct, reconstruct, maintain, and operate within the City of Elk River <br />a gas distribution system to North Central Public Services upon the recom- <br />mendation of City Attorney David Sellergren, publication of this ordinance <br />costs to be paid for by North Centeral Public Services. Motion unanimously <br />carried by a vote of 3-0. <br /> <br />Mr. Chuck Christian and Mr. David Peterson representing Peterson Acres <br />Development met with the Council regarding the article that appeared in <br />last weeks Sherburne County Star News. Mr. Peterson stated <that every <br />person that purchase a track or parcel of land in his development receives <br />a copy of Burlington Northern private crossing permit agreement form, <br />the owner then in turn must complete the form along with $25.00 payable <br />to Burlington Northern, Inc. in order to receive their copy of the agreement. <br /> <br />Mr. Christian stated that it was the:Lr intention that once all tracks and <br />parcels of land had been sold in this development they planned to form or <br />establish an association comprised of all the property owners. ,The assoc- <br />iation would be in control of all road maintenance, development, and im- <br />provement, ana ilupluvelllents to their development. Mayor Madsen stated as <br />long as each and every one owning property in this development are totally <br />aware that these streets, are not city maintained or city owned, and that <br />the association, will be responsible for all maintenance, grading, paving <br />and plowing. <br /> <br />Street Superinentendent, Ken Nelson met with the Council regarding the dog <br />catcher situation. Mr. Nelson stated that a firm in Blaine, Minnesota <br />"Blaine Midway All Pets" offers the [d:,tlowing services. $10.00 per hour <br />for pick-up, $3.00 per day housing of the animals. Several questions were <br />asked regarding these services, therefore it was suggested that Mr. Nelson <br />invite a representative of this firm to our next scheduled Council meeting <br />April 17, 1978. Other matters of discussion were purchase of a truck <br />with a plow and wings to be used in the township area and crack filling <br />road maintence. <br />
