CHAPTER 16 <br /> • Certain procedures guide the adoption and amendment of the <br /> Minn.Stat.§462.355. comprehensive plan. Either the planning agency recommends <br /> the plan to the council, or the council proposes the plan to the <br /> planning agency by resolution. A public hearing must then be <br /> held by the planning agency prior to the adoption of the plan. <br /> Notice of the hearing must be published in the official <br /> newspaper at least 10 days prior to the date of the hearing. The <br /> council cannot adopt or amend the plan unless the planning <br /> agency's recommendation to do so is received, or 60 days have <br /> elapsed since the council's proposal by resolution was <br /> submitted to the planning agency. A two-thirds vote of all the <br /> members of the council is required to adopt or amend the <br /> comprehensive plan. <br /> All acquisitions and dispositions of real property and any <br /> Minn.Stat.§462.356. capital improvements must be reviewed by the planning <br /> agency regarding the consistency of the proposed action with <br /> the comprehensive plan. Written compliance reports must be <br /> submitted to the council or the proposal will be deemed <br /> approved after 45 days.The council may override the necessity <br /> of this review and reporting requirement by a two-thirds vote <br /> upon finding no relation between the proposed action and the <br /> comprehensive plan. <br /> Zoning as an important tool <br /> in implementing the <br /> comprehensive plan <br /> See League memo,Zoning:A Zoning establishes a land use pattern and the orderly <br /> Guide for Minnesota Cities, development of various types of districts according to the best <br /> use of particular areas of a community. <br /> Minn.Stat.§462.357. Specifically,these ordinances may regulate <br /> the uses of property, the height, width and size of buildings <br /> and the amount of vacant space on lots in each district.
