HANDBOOK FOR MINNESOTA CITIES <br /> • Review of land acquisitions and capital • <br /> Minn.Stat.§462.356,subd.2. improvements.Once an agency adopts a <br /> comprehensive plan or part of a plan, all proposed <br /> land acquisitions and capital improvements of the city, <br /> or any other governmental unit with jurisdiction in the <br /> city,must go to the commission for review. The <br /> agency will then submit a written report describing its <br /> findings. (The council may,by two-thirds vote, <br /> dispense with this requirement if it feels no planning <br /> implications are involved.) Failure to report in 45 days <br /> is deemed approval. <br /> The planning commission or agency is responsible for <br /> reviewing land use control measures. The Planning Act <br /> requires the planning agency to review zoning ordinance <br /> amendments, subdivision plats and official maps. Public <br /> hearings may be held before the planning agency, but the <br /> council makes the final determination. Under most city <br /> ordinances, all council determinations having planning <br /> implications first go to the planning agency. <br /> Minn.Stat.§462.354,subd.2. Finally, the planning agency or commission may get the <br /> assignment from the council to act as a board of adjustments <br /> and appeals. Again,every city that has a map in effect, must <br /> establish a board of adjustment and appeals. However,because <br /> • <br /> the board has the authority to review the decisions and <br /> recommendations of the planning agency, it is usually better to <br /> have a board whose members are different from those of the <br /> planning agency. <br /> Executing and implementing <br /> the comprehensive plan <br /> Southern Burlington County Any plan is only as good as its execution.
