COUNCILMEMBER ENGSTROM SECONDED <br />THE MOTION. THE MOTION PASSED 4~O. <br /> <br />Councilmember Gunkel questioned the method of assessment as proposed in the city <br />Administrator's memo dated July 12, 1984 to the Mayor and City Council and further <br />indicated that it was her recommendation to assess more than as proposed. <br /> <br />,6. Vacation of Holt Avenue Road Easement~ Public Hearing <br /> <br />The City Administrator indicated that the road easement vacation public hearing was <br />held to vacate a portion of a road between Railroad Drive and 3rd Street. The <br />City Administrator indicated that the portion of the roadway was supposed to have beer <br />vacated by the Elk River City Council in 1969, but apparently was not recorded, as <br />the County's records currently show the road still in City ownership. The <br />City Administrator indicated th~t in order to:cla:rify the status of the roadway, the <br />City Council may officially and formally complete the easement vacation as intended <br />by the 1969 City Council. <br /> <br />Mayor Hinkle opened the public hearing. No one appeared for or in opposition of <br />the road easement vacation. <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO VACATE THAT PORTION OF THE CITY STREETRIGHT-0F-WAY <br />KNOWN AS HOLT AVENUE BETWEEN THIRD STREET ANDRAIL~OAD DRIVE, ADJACENT TO THE SUPER <br />VALU AND AMERICAN LEGION PROPERTIES. COUNCILMEMBERGUNKEL SECONDED THE MOTION. <br />. - <br />THE MOTION PASSED 4~O. <br /> <br />7. Americ-an Legion Conditional Use Permit - Continued Public Hearing <br /> <br />Councilmember Gunkel indicated that the public hearing to consider a conditional <br />use permit request by the American Legion was continued from the April 16, 1984 City <br />Council meeting; CounGilmember Gunkel indicated that the condition.al use permit <br />is requi:red to allow the American Legion to expand their facility in a C~4 zone, <br />Councilmember GunkeL indicated that the City Council could not consider the condition- <br />al use permit request at the April 16th City Council meeting, as a detailed site <br />plan indicating parking requirements, landscaping and traffic flow was not available. <br /> <br />The City Administrator indicated that the current site plan is not the final plan for <br />the American Legion addition and further indicated that the final plan would be a <br />part of the conditional use permit when the American Legion applied for the building <br />permit. <br /> <br />General discussion was carried on regarding the porposed landscaping and the City <br />staff's suggestion that more lal1dscaping be put .il1 place at the piece adj acent to <br />Main Street. Discussion was also carried 011 regarding the curbing requirement <br />to be continued by the American Legion for the full length of the property on Rail~ <br />road Drive. <br /> <br />COUNCILMEMBER GUNKEL MOVED TO APPROVE THE CONDITIONAL USE PERMIT REQUEST BY THE ,.. <br />AMERICAN. LEGION WITH THE CONDITIONS THAT A FINAL PLAN BECOME A PART OF THE CONDITION~ <br />AL USE PERMIT AND THAT THE LEGION COMPLY WITH THE MINIMUMS ON THE ESTABLISHED PLAN <br />THAT AN ADDITIONAL SITE. PLAN BE PROVIDED. AND THAT CONCRETE CURB AND GUTTER BE <br />. ~ <br />EXTENDED FOR THE WHOLE LENGTH OF THE PROPERTY ON RAILROAD DRIVE FROM THE POINT OF <br />THE CURB TO BE CONSTRUCTED IN CONJUNCTION WITH THE MAIN STREET PROJECT.
