The City Administrator indicated <br />that the property is 200 feet away from a residence and would be buffered by <br />the condition of the conditional use from the residential property. The City <br />Administrator further indicated that the proposed use would not affect the <br />valuation of the property in Elk Hills any more than any other use. The City <br />Administrator indicated that single family residential will .not work next to <br />v the MaDonalds Restaurant and further indicated that commercial zoning would <br />be highest and best use of the property. <br /> <br />Mr. Arlon Fuchs indicated that he felt the property could be used for a duplex. <br />The City Administrator indicated that the topography of the land would not <br />lend itself well to any use other than a use that would have highway frontage. <br /> <br />Mr. Larry Tothindicated that there is other connnercial. property available in <br />the area, specifically, the Barrington planned unit development and also within <br />the City, therefore, felt the City should not rezone additional property to C-3. <br /> <br />Various residents of the Elk Hills Addition expressed their opposition to the <br />proposed zone change and conditional use ~ <br /> <br />Discussion was carried on regarding the Planning Commission and their qualifications <br />for serving on that commission. <br /> <br />Discussion was also carried on regarding traffic control and traffic problems <br />in the area of Dodge Avenue and Elk Hills Drive. Further discussion was carried <br />on regarding the. Planning Commission'sreconnnendation. <br /> <br />Mr. Cliff Lundberg expressed his concern about the buffering and indicated that <br />he felt the City Council should be concerned that a buffer be required between <br />the connnercial property and the Elk Hills residential area. <br /> <br />Mr. Jim Neilson, attorney and representative for Mr. George Dietz, indicated <br />that the City Council was ina difficult position as they must make a decision <br />that would best serve the City. of Elk River. Mr. Neilson indicated that the <br />proposed use of the property on Highway 4f169 would create more taxes for the City <br />of Elk River and would help pay for aw~ter trunk line which is necessary to <br />serve the area. Mr . Neilson indicated that Parcel C of the administrative sub- <br />division was sold to Mr. Milo Henneman to allow more land to be used as a buffer, <br />and further indicated that Parcel B would be a buffer to the Elk Hills residents. <br />Mr. Neilson indicated that Mr. Earl Hetrick's house is 232 feet from the north <br />line of Parcel A. Mr. Neilson indicated that as proposed on the site plan, the <br />two large oak trees on Parcel A would not be removed. Mr. Neilson indicated <br />that Mr.>Dietz offered the property for sale to the residents and specifically <br />Parcel B, to Mr. Earl Hetrick at a very reasonable cost. Mr. Neilson indicated <br />that Highway 4f169 in itself will create traffic which will affect the Elk Hills <br />residents and further indicated that property fronting on Highway #169 could <br />best be used as commercial property. Mr. Neilson further indicated that the <br />proposed zone change and conditional use is con$istentwith. the City J s land use. <br />
