THE MOTION PASSED 3-0. <br /> <br />9. Art Hidde Administrative Subdivision Request - Public Hearing <br /> <br />Mayor Hinkle indicated that Mr. Art Hidde of 19171 Zebulon Street, is requesting <br />an administrative subdivision to allow him to consolidate Lots 6 and 7, Block 1, <br />in Village Estates 2nd Addition, and to add the north twenty (20) feet of Lot 6 <br />to Lot 5, Block 1, Village Estates 2nd Addition. <br /> <br />Mayor Hinkle opened the public hearing. No one.appeared for or in opposition of <br />the administrative subdivision. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE AN ADMINISTRATIVE SUBDIVISION FOR MR. ART <br />HIDDE IN THE VILLAGE ESTATES 2ND ADDITION. COUNCILMEMBER GUNKEL SECONDED THE <br />MOTION. THE MOTION PASSED 3-0. <br /> <br />10. Zoning Ordinance Amendment to Allow Daycare Facilities as a Conditional Use in <br />the C-3B Zone - Public Hearing <br /> <br />Councilmember Gunkel indicated that Mrs. Bonnie Eckdahl of 18679 Boston Street, <br />has requested that the City's Zoning Ordinance be amended to permit daycare and <br />preschool facilities as a conditional use within the City's C-3B zone. Council- <br />member Gunkel further indicated that the C-3B zone was created for more flexible <br />use of HIghway Commercial districts. Councilmember Gunkel indicated that the <br />Planning Commission considered Mrs. Eckdahl's request and voted unanimously to <br />deny the request as they felt daycare and preschool facilities are incompatible <br />with the other uses allowed in a C-3B zone. Councilmember Gunkel further indicated <br />that the Building and Zoning Administrator also felt that the daycare/preschool <br />facility is not compatible with C-3B Highway Commercial. Councilmember Gunkel <br />indicated that in the State licensing procedure, after the fire department and <br />building and zoning department have certified that the location is acceptable, <br />the State is primarily concerned with the facility itself with regard to toilet <br />facilities, kitchen facilities and play area. Councilmember GunkeL further <br />indicated that there is a daycare center facility located on Highway #10 in <br />Anoka and there are othe~ daycare facilities located in shopping centers, which are <br />both high traffic areas., <br />I <br />Mr. John Fitzgerald, representative of Ms. Bonnie Eckdahl anp Ms. Jody Kreuser, <br />indicated both Ms. Eckdahl and Ms. Kreuser agree that it is not the best facility <br />in Elk River, but the ne~d is there and this particular building is all that they <br />can find that is availab+e and affordable. Mr. Fitzgerald indicated that the <br />building has the basis t~ meet the State's requirement for kitchen and toilet <br />facilities and it does h~ve ample play area that would be fenced. Mr. Fitzgerald <br />indicated that the ownerjof the property has also indicated that he would fence <br />the parking lot as well,ito provide for the safety of the children. <br /> <br />The City Administrator q~estioned the proposed fence area. <br /> <br />Discussion was carried o~ regarding truck traffic in the area and the type of <br />fencing and the location1of fencing. <br />
