Memo to Planning Commission/0A96-2 Page 6 <br /> April 23, 1996 <br /> • conditional use permit would have a list of criteria which needs to be met in <br /> order for the Planning Commission and City Council to approve a <br /> development project without municipal services. The following is a sample <br /> list of criteria that could be considered to approve a conditional use permit: <br /> 1. Developer submit a signed petition for improvements, waiving their <br /> rights to future assessments. <br /> 2. Executing a developer's agreement outlining the terms and conditions <br /> for development plan approval, future assessments and prepayment of <br /> any fees. <br /> 3. Payment at the time of building permit of a "utility fee" to cover the <br /> costs of future trunk assessments. <br /> *There may need to be some provision that states a sunset date <br /> allowing the prepaid funds to be returned if utilities are never <br /> extended. <br /> 4. The proposed development satisfies all building and fire code <br /> requirements (i.e., sprinkling) that can be adaptable when city water <br /> and sewer are ultimately made available. <br /> • 5. The City's long range planning efforts are not compromised as a result <br /> of the development proposal (i.e., developer install necessary <br /> infrastructure to accommodate the projected needs). <br /> Another consideration would be to allow existing businesses the opportunity <br /> to expand but not allow any new development. This would preserve the <br /> "intent" of not allowing premature development while, at the same time, <br /> providing those businesses in existence some flexibility. <br /> Certainly another option would be to maintain the current ordinance and <br /> continue to implement a growth management plan that has been in place <br /> since 1988. <br /> East Highway 10 Study <br /> The City is in the process of having an appraisal completed for the east <br /> Highway 10 corridor. This appraisal will assist the City in understanding <br /> the financial aspects of extending water and sewer at the same time, the City <br /> Council may be having a public meeting on extending water and sewer in <br /> either May or June. It may make sense to delay action on this item until the <br /> IIIappraisal and public hearing are completed. <br /> s:\planning\pc\oa96-2xx.doc <br />
