CI l egEeC_ EXEc_ors.42 <br /> • DEERFIELD THIRD ADDITION <br /> OUTLOT A <br /> CONDITIONAL USE PERMIT <br /> PLANNED DEVELOPMENT AGREEMENT AND <br /> DEVELOPER' S AGREEMENT <br /> THIS AGREEMENT, made and entered into this day of <br /> , 1990, by and between the CITY OF ELK <br /> RIVER, a municipal corporation organized under the laws of the <br /> State of Minnesota (the City) , and ELK RIVER DEVELOPMENT <br /> CORPORATION (the "Corporate Developer" ) , and GERALD SMITH, LEO <br /> POLACK and LOUIS POLACK (the " Individual Developers" ) <br /> collectively referred to hereinafter as the "Developer" ; <br /> WITNESSET H: <br /> WHEREAS, the Developer has made application to the City for <br /> • an amendment to the planned development and subdivision of a <br /> plat of land located within the City and legally described as <br /> follows : <br /> Outlot A, Deerfield 3rd Addition, Sherburne County, <br /> Minnesota <br /> (the Property) ; and <br /> WHEREAS, the City Council by motion adopted August 20, <br /> 1990, has granted planned development as amended for the <br /> development of on the Property (the <br /> Development) , subject to certain conditions, including that <br /> Developer enter into appropriate agreements with the City so as <br /> to fully comply with the City' s Zoning and Subdivision <br /> Ordinances; and <br />
