Consider a Conditional Use Permit Renewal by Commercial Asphalt, Public <br /> Hearing, Case No CU 94-07 <br /> Staff report presented by Steve Rohlf. Commercial Asphalt requested a two year <br /> renewal of their conditional use permit for a gravel mining related facility <br /> (temporary asphalt plant). <br /> Chairman Tveite opened the public hearing. <br /> Nathan Bunker, 20347 Highway 169, Elk River, commented on the odor problem <br /> and wanted someone to identify the emissions they are breathing. <br /> Al Fifel, Auburn Street, Elk River, stated he is opposed to the renewal of <br /> Commercial Asphalt's conditional use permit. Mr. Fifel stated that on certain <br /> days, the odor is nauseating and the smoke layer is very thick (photographs and <br /> a letters from an area resident were presented to the Commission). <br /> Brenda Bunker, 20347 Highway 169, Elk River, stated that she is also opposed to <br /> the conditional use permit renewal. The odor is awful on some days and she <br /> questioned the quality of air they are breathing. Mrs. Bunker enter two (2) more <br /> letters from area residents. <br /> Chairman Tveite read the letters and entered them into public record. <br /> Gary Sauer, Commercial Asphalt, introduced himself and addressed the Planning <br /> • <br /> Commission. Regarding the Draft EIS, Mr. Sauer invited the Planning Commission <br /> to come to Maple Grove and view their restoration process. Regarding the <br /> recycling process and the odor problems, the plant has done much to help <br /> reduce the noise, however, the odor problems are somewhat more of a <br /> challenge. Mr. Sauer assured the Commission that Commercial Asphalt would do <br /> everything possible to try to reduce the odor and smoke including raising the <br /> stack and monitoring the smoke levels on a daily basis. They are completely <br /> willing to work with City staff and implement suggested modifications as <br /> necessary. Further, they are researching the possibility of a new facility north of <br /> the present site. Dick Peterson, of Commercial Asphalt, commented on emission <br /> monitoring and the actual procedures at the plant. <br /> Questions from the Commissioners included explaining the process of recycling <br /> asphalt, the mixing operations and State requirements, emission monitoring, and <br /> how to monitor and adjust the mixing process to produce lower levels of smoke <br /> and odor. Dick Peterson explained the variables involved with the mixing process <br /> and how the State must approve all mixing percentages used prior to <br /> implementation. <br /> Nathan Bunker, 20347 Highway 169, Elk River, stated that every morning there is a <br /> smoke and odor and he is very concerned about the quality of air they breathe. <br /> Mr. Bunker stated that some days it actually hurts to breathe the air in their own <br /> yard. <br /> Steve Rohlf explained the possible options for the plant: 1) modify the plant <br /> • operation; 2) modify the plant (burner, equipment, etc.); 3) relocation of the <br /> pc3-22.minutes <br />
