<br />e <br /> <br />e <br /> <br />e <br /> <br />Page 8 <br /> <br />Elk River City Council Minutes <br />December 21. 1987 <br /> <br />The City Administrator stated that the Council should look closely at the <br /> <br />variances requested. especially since they are for raw land. He indicated <br />that platting should be able to be done according to the City Code. <br /> <br />Mr. Weicht indicated he could not build the townhomes without the <br />variances. He indicated he felt he was dealing with a hardship due to the <br />number of easements running through the land. <br /> <br />Mr. Jim Nystrom stated his concern regarding shortage of parking spaces. <br /> <br />Mayor Gunkel closed the public hearing. <br /> <br />Councilmember Tralle indicated he felt there was a hardship due to the <br />easements on the land. <br /> <br />Councilmember Holmgren expressed his concern regarding a recreational play <br />area for each four unit building. <br /> <br />COUNCILMEMBER TRALLE MOVED DENIAL OF 2 FOOT VARIANCE ON THE REQUIRED 22 <br />FOOT DWELLING WIDTH. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE <br />MOTION CARRIED 4-0. <br /> <br />COUNCILMEMBER TRALLE MOVED TO RECOMMEND APPROVAL OF AN 8 FOOT VARIANCE ON <br />THE 30 FOOT MINIMUM LOT WIDTH FOR LOTS 2.3.6.7.10. & 11. COUNCILMEMBER <br />SCHULDT SECONDED THE MOTION. <br /> <br />Discussion was held regarding the standards for a variance. It was noted <br />that the easements were in place before the property was purchased. <br />thereby causing a hardship. Councilmember Schuldt indicated he did not <br />feel this warranted the granting of the variance. <br /> <br />THE MOTION PASSED 3-1. COUNCILMEMBER SCHULDT VOTED NAY. <br /> <br />COUNCILMEMBER TRALLE MOVED APPROVAL OF THE PRELIMINARY PLAT OF PROCTOR ONE <br />WITH THE FOLLOWING CONDITIONS: <br /> <br />1. THAT PRIVATELY OWNED LATERAL SEWER AND WATER LINES BE PLACED IN AN <br />EASEMENT ALONG WITH THE PRIVATE DRIVE. AND THAT EACH DWELLING UNIT <br />STAY WITHIN THE BOUNDARIES OF ITS LOT TO HOOK UP INDIVIDUALLY TO THOSE <br />LATERAL WATER AND SEWER LINES. <br /> <br />2. THAT THE FINAL DESIGN OF THE WATER AND SEWER LINES BE APPROVED BY MR. <br />MAURER. <br /> <br />3. THAT THE PETITIONER GAIN APPROVAL FROM MPCA FOR EXTENDING THE SEWER <br />AND WATER LINES. <br /> <br />4. THAT A TOWNHOUSE ASSOCIATION AGREEMENT AND MAINTENANCE AGREEMENT BE <br />ENTERED INTO FOR THE ROAD. SEWER AND WATER LINES. THE PETITIONER <br />SHOULD HAVE THE AGREEMENT PREPARED AND THE CITY ATTORNEY WILL REVIEW <br />IT. <br />
