<br />Page 2 <br /> <br />Elk River City Council Minutes <br />December 21. 1987 <br /> <br />tit <br /> <br />5.1.Consider Past Approval of Adminstrative Subdivision/Floyd Kruse <br /> <br />Mayor Gunkel indicated that the Council approved an administrative <br />subdivision for Floyd Kruse on November 16. 1987. to split one parcel of <br />land into four parcels with the stipulation that each of the three <br />existing businesses have their own well and septic system within one year. <br /> <br />Steve Rohlf stated that Mr. Kruse is requesting to record only one lot and <br />put the well on the lot after it is recorded. <br /> <br />Cliff Lundberg stated that the reason for recording only one lot is <br />because only one lot is sold at the present time. <br /> <br />Mayor Gunkel stated that all 4 lots should be recorded at the same time. <br />Councilmember Holmgren stated he saw no reason why the Council should not <br />honor the request and allow one lot to be recorded. <br /> <br />The Council discussed different options to ensure that the wells and <br />septics will be put in. if the applicant is allowed to record the split <br />prior to them being installed. <br /> <br />e <br /> <br />COUNCILMEMBER TRALLE MOVED THAT ALL FOUR LOTS BE RECORDED AT ONE TIME AND <br />THAT A DEVELOPER'S AGREEMENT. IN A FORM APPROVED BY THE CITY ATTORNEY. BE <br />ENTERED INTO AND THAT A LETTER OF CREDIT BE SUBMITTED TO THE CITY OF ELK <br />RIVER TO ENSURE THAT THE WELLS AND SEPTICS WILL BE INSTALLED. <br />COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 3-1. <br />COUNCILMEMBER HOLMGREN VOTED NAY. <br /> <br />5.2.Administrative Subdivision Request by Marian Foss/Public Hearing <br /> <br />Mayor Gunkel explained that Marian Foss is requesting an administrative <br />subdivision to split an approximately 9.6 acre parcel into four lots. The <br />four lots proposed will meet the minimum 125 foot of frontage and one acre <br />lot size required for nonsewered lots within an R-1b zone. It was further <br />noted that all four lots proposed have sufficient frontage to meet the 75 <br />foot minimum frontage requirement for R-1b sewered lots if the lots were <br />split again in order to have smaller lots if the area were provided with <br />city sewer. <br /> <br />Mayor Gunkel opened the public hearing. There being no one for or against <br />the matter. Mayor Gunkel closed the public hearing. <br /> <br />e <br /> <br />COUNCILMEMBER TRALLE MOVED APPROVAL OF THE ADMINISTRATIVE SUBDIVISION <br />REQUEST FOR MARIAN FOSS FOR PROPERTY LEGALLY DESCRIBED AS THE N 660 FT. OF <br />THE S 1.210 FT OF THE E 660 FT EXCEPT THE S 100 FT OF THE E 200 FT THEREOF <br />IN THE SW 1/4 OF THE SW 1/4 OF SECTION 30. TOWNSHIP 33. RANGE 26 WITH THE <br />STIPULATION THAT $600 PARK DEDICATION FEE BE SUBMITTED TO THE CITY AND <br />THAT FOUR NEW LEGAL DESCRIPTIONS BE SUBMITTED PRIOR TO RECORDING THE LOT <br />SPLIT. COUNCILMEMBER HOLMGREN . SECONDED THE MOTION. . THE MOTION CARRIED <br />4-0. <br />
